    That is rubbish from the ICO. If your vehicle shows up again on Britannia's cameras or whatever Britannia will have no way of knowing (i) whether it's still your vehicle, until they ask the DVLA again and (ii) even if it is still your vehicle, who is driving it. Given that the driver (a) might not be you and (b) might be willing to take the rap and not leave you liable, it's as clear as day to me that Britannia has absolutely no right to keep your data on file just in case your vehicle shows up again!

    If I were you I'd respond to this inadequate reply with a formal complaint about the ICO:

  • Thank you Coupon-mad and bazster, I couldn't believe what she was saying either ... I was really shocked. First of all I wondered if she was new and/or inexperienced and had it wrong, but she was emphatic and bullish, and when I tried to say it was unreasonable she just repeated everything she'd said over again. She just seemed to think their behaviour was fine and I was being unreasonable. Crazy! I will look at your link bazster and may well complain to the ICO. Will keep you all informed :).

    The ICO is complicit in the PPC farce, just like DVLA. Some of these complaints need to get escalated all the way i.e. MP and Ombudsman.

    Funny you should say that bazster, I told the ICO woman at the end of the conversation that I will probably write to my MP at the House of Commons and ask if he thinks if its reasonable (or compliant with data protection principles) for a PPC to keep an individual's vehicle details on file, for an unspecified amount of time, for the sole purpose of 'monitoring' that individual. She just repeated her suggestion that I write to the BPA.

    I think you should make a formal complaint to ICO first. Your MP will not be able to take it to the parliamentary ombudsman unless you've exhausted ICO's own complaints process first.
