Exel Parking Ltd Ebbw Vale PCN!

Hi everyone,

Okay so heres the gist of the situation, essentially I did not pay to park in the car park (I assumed since everything was shut at the time and the day of the week it'd be fine) So car was parked up to eat food from Mcdonalds (lol did not want parking eye on my backside for being in the other car park -.-)

Anyway, so yeah Had a lovely threatening letter from Excel today demanding money.

What do i do? Of course old advice is to ignore (which isn't relevant now) but was successful for the boyfriend and his father before.

Anyway, do I contact them? If so I plan to use the template on the newbies thread to contact them if i do.

So can you guys help? / Advise me if you've dealt with excel in the past? Or should I have taken my chances with parking eye?

Sorry need to have a laugh don't we?

    use the template in the newbies thread as you were advised in that other similar thread

    send it in online or by post with free certificate of posting at the post office (not recorded)

    then use the exact same legal appeal to popla (from that other vortech thread) if they give you a popla reference code when they reject your appeal

    ps:- this is Excel , not Parking Eye
  • Yeah I know it's excel, but ebbw vale have i think 2 or 3 different parking companies operating around that little area. I'm aware parking eye is for aldi, and excel is for Dominos and the area in which myself and vortechs have PCNs for.

    I'll get on that asap, quite busy with job interviews however, this is laughable as they are only elligable to get like what 30p back from this? Not £60 or £100 or whatever else they will add to this.

    they may be entitled (if the contract says so) to get back the losses incurred , which would be what the charge would have been on the day, also reasonable recovery costs , which the OFT put at £12 and general consensus is that it lies somewhere between £3.50p and £16 , so not just the actual parking fee but restitution in getting it, this applies to any PPC including excel and pe , but as you said yours is excel then its excel and then popla , same as vortechs

    so you should plagiarise his thread for your own appeals , especially the popla appeal

    use the coupon-mad template letter as the initial appeal

    so almost copy and paste for you

    Hi again misfitgemma,

    It is a bit ironic that in an effort to escape the clutches of P Eye(who presumably are infesting the McD's car park) you ran straight into the clutches of Excel :D

    As luck would have it you at least ended up with the less nasty of the two, but both are easily seen off with forum aided appeals.

    So send your 1st Appeal off to Excel - either the template 1st appeal or the shorter version VorTechs used (see post #6 of that thread) will be fine.

    If posting take to the post office and get a free cert of posting (Do NOT use signed for or Registered - they refuse to sign for them)

    Then when they reject your appeal, which is the expected result of a 1st appeal, they must supply you with a POPLA code.

    When you've got the POPLA code come back on for help and advice drafting a POPLA appeal - which will be very similar to the one on the other thread.

    If they try to mess about by sending anything other than a cancellation letter or a rejection letter including a POPLA code also come back on for advice.

    ps. Re: the photos - you will probably need to take some for yourself (not needed before 1st appeal though) so you can check the details on them before you send in your own POPLA appeal and very kind of you to offer to share these with VorTechs.
  • I believe they are, I know they infested the Aldi's one and im terrified of parking there. Normally pay in this car park, just the one time i didnt think anythiong of not doing it and i get done! nevermind!

    Yeah i'm going to take some pictures.

    They now have the attendants going about down there in the day time too. But because it was empty, again. i thought nothing.

    Just to check - was your PCN a postal notice (and did it arrive within 15 days of the alleged event?)

    or was it windscreen ticket?
    If a windscreen ticket the advice is to wait until the postal notice to keeper arrives (which must come between 29 and 56 days from the alleged event)
  • It was a postal notice receieved 9 days after date of it apparently.

    Ok - so it was in time then - would have just meant an extra appeal point if it had arrived after 15 days - but you will be ok with the three points in the template 1st appeal.
