ending a tenancy and last months rent

hi, it me again!

I posted a week or so ago about our letting agency as they like to call themselves. I gave them my 30 days notice on 06/04 but i said in the letter that we would be leaving on the 18/05 which is more than 30 days notice. They have sent a reply today saying we need to leave on the 06/05 as this is 30 days. I understand this, however the rent comes out on the 18th of every month therefore if we leave on the 6th we will only be in the property for 14 days into that month rental period. Are they right to want us out half way through?
I am so angry with them, ever since we have moved in we have had problems with the flat. The intercom to the main entrance has never worked so noone can contact us to say they are here or have deliveries. The electrics were dodgy, the washing machine and cooker broke....the list goes on. Each time we have reported the problems, its taken them months to put them right. The intercom is still broken after 7 months because they refuse to accept responsibility for it. The money they want from us is extortionate! they wanted £240 for a renewal not to mention that we paid £375 in application fees when we moved in 6 months prior. The best part of that is, we had to find our own references as they lost ours and we delivered them ourselves. I am soooooo tempted to cancel the standing order for the rent! I know this is not the thing to do as it will affect my credit report and we can get sent to court, i just feel there are no options for tenants and we have no rights. We have tried the ombudsman but every letter of complaint we have sent to the ll they refuse to reply so apparently 'we have not followed the complaints procedure'
I know they are going to take every little fault they can find out of the deposit and we have an 'inventory fee' of £120 to come off that before we even start. I dont know what to do, can anyone shed any light before i go crazy?

    What are the "from" and "to" dates on your original tenancy agreement?

    Normally, you would need to give at least a full month's rental-period's notice. A rental-period does not necessarily coincide with the date the rent is paid.

    It's a nonsense to demand you pay rent for days after your surrender of the property but leaving before a period ends should be your choice and not the landlord's/agent's.

    You were previously advised to "give notice in writing and one calendar month not 30 days to line up with your tenancy agreement".

    If you didn't understand what that meant it would have been sensible to have asked for clarification at the time.
  • Our letting agent asked for 30 days and we gave more than that! we paid the first months rent on the day we moved in and signed the tenancy which was the 18th, the rent has gone out on the same date ever since. I am well aware of the amount of notice we need to give and the period of the contract. My question was actually regarding whether they were able to tell me to leave earlier than the end of my rental period and if so do we have to a full months rent even though we only in there for 2 weeks?

    No, they cannot insist that you leave earlier then the last day of your rental-period and they also cannot insist that you pay rent for days after that date.

    If your rental-periods run from the 19th of the month to the 18th of the month following just write back and tell them that you'll be leaving on the 18th of May as planned and that you'd like to arrange for the check-out inspection to be carried out on that day.
