Appeal following NTK rejected PCP

Hi,

I received a NTK dated 18.03.14 to which I replied within the 14 days as the registered keeper using the newbies template from this site - notifying them that as keeper I wished to appeal. I have since received a (rather poorly written) response stating that the appeal can't be processed as it was sent outside of the 28 days permitted to the driver and that as driver I have forgone my right of appeal.

Fair enough you think - but I can 100% state that I wasn't the driver - I was about 10 miles away from the particular car park at the time - at work. I am not the only person with access to the vehicle though.

Any advice on what to next would be appreciated.

    Write to them again (attach a copy of your appeal) stating that you were not the driver and did not appeal as the driver, you appealed as the registered keeper. Tell them that either they accept your appeal or they reject it and issue you a POPLA code.

    Also, complain to the BPA. Contact details are in the Newbies sticky thread.

    Have a read of the IPC Code of Practice and complain to them and to the DVLA that as a non-driving registered keeper you are being denied your right to appeal the ticket even though under POFA 2012 you could be held liable. How is this fair, what are the IPC and DVLA going to do about it, how could a keeper know about a ghost ticket or one issued when they were not driving? How can a keeper be held liable yet be denied an appeal, and ask the DVLA why the two ATAs (the BPA and the IPC) are not the same in this regard, where is the consistency? And this isn't a mere detail, it's fundamental.

    Email addy for the DVLA is in the NEWBIES sticky thread, post #6 about making complaints. Do not write to the BPA, it's the IPC and you'll need to familiarise yourself with their CoP as it's different and even the regulars here aren't fully au fait with it yet.

    Excellent synopsis of the point by c-m. Use it when you complain to the DVLA. David Dunsford is the person to contact and threaten to involve your MP as well.

    It would be useful to add the IPC email address to post #6 as well coupon I think
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
