Paul Simon Administration Help

Hi,

Can anyone give me any indication if I have any chance of receiving any refunds or goods from Paul Simon beds, as I ordered a single bed for my daughter over 8 weeks ago by debit card for £220 and went into store to get a refund to be advised they went into administration?

Have sent administrators details and spoken to bank but none seems to know anything apart from me having to send more details as money doesn't grow on trees and I cant afford to by my daughter a new bed again and very angry atm, just wish the administrators could seize all director and senior managers assets and kick them into the streets


any advice guys would be really appreciated

    Contact your bank about a chargeback for non-delivery.

    The whole point of setting up a limited company is that it limits the liability (financial and in some cases criminal) of those running the company - so their personal assets are not at risk if the business runs into trouble.

    Whether or not you will get the bed or a refund will depend largely on whether the business is restructured/sold on as a going concern or not. If it is sold on as a going concern then the new owners will probably try to honour existing orders and you might get the bed. If not, then the business will probably be closed and all assets sold off to repay creditors - you will become a creditor and may get some money back if enough is raised from the sale of assets. Unfortunately creditors are paid in an order, and consumers are often quite low down the list.
    Common sense?...There's nothing common about sense!

    Which debit card, some do offer charge-back, but you do have to shout your way past the goon that answers the phone to the next level.

    did contact my bank who are sending me a form to complete but they didn't actually say it was chargeback but did sound like it as they needed evidence of non fulfilment of order and company had gone into admistration

    Visa Debit card - Does charge back only limit upto £100 refund?

    Not long ago I did a successful chargeback via my bank for a debit card payment to an appliance company that went into administration just a few days after I made payment to them.

    I didn't hold out much hope for getting a refund under the circumstances, but was very pleased to hear from my bank within a very short time to say money had now been refunded to my account.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    As my local store is having a closing down sale then I fear this is the more likely outcome
