What should i do?

I hope i'm on the right board? Apologies if not
I'll try not to waffle but want to give as much information as possible

I was a member at DW gym. I joined...then in June last year i changed membership from off peak to peak.

In january of this year i left employment. Down to personal circumstances i don't wish to go in to. But the main thing is i went in to the gym and tried to cancel. They wouldn't let me cancel until i provided proof of being unemployed. I STILL don't have my p45 from my previous employed despite keep asking them for it. I was unable to prove i was no longer employed in time for the direct debit so i cancelled it. I had far more important bills to pay and my children to provide for. I know i was still in contract but it was a decision i had to make.

I emailed them explaining my situation and asked for a little compassion and understanding. Especially as i had been a member for a long time, well over 12 months. It just happened that i changed my membership which put me in a new contract :(

Then i get solicitors letters demanding £44 in unpaid fees. Then i've just had a letter saying if i don't pay the £44 it will go to court and i will have to pay almost £200 when other fees have been added. It also states on the letter it 'may' be taken to court.

Do i sweat it out and see if it goes to court? pray that they don't bother for that amount? or do i bite the bullet and pay the £44 ?

I know i was in a contract but really i could do without paying it :(

Any advice apreciated, thanks in advance xx

    I think as you were under contract you will need to pay the £44.

    Why not ask your ex-employer to send a letterheaded note stating the date your employment terminated? Or show them proof of benefits?

    Have they now cancelled your membership or is it still going?
