Need some advice re: Bank Charges

Hi

I realise that this forum might not be the right place for this post but it was the closest match I could find.

I need some advice with a problem I am having. About 4 years ago I closed my Lloyds TSB account and Lloyds added about £500 of unlawful charges to the account (for unauth o/d, rtnd dd etc) I coughed up £50 as a goodwill gesture but informed them that as the charges were not lawful I would not be paying them (i have a sister that had gone through something similar so knew they were illegal)

Now Lloyds passed on the debt to Thames Credit who I have refused to deal with as I acknowledge no debt to them. Recently I have been getting letters from Buchanan Clark and Wells threatening legal action. I have contacted BCW over phone and in writing explaining that the original 'debt' is not valid as the charges were unlawful. I have warned them that if they continue to chase I will regard this as harrassment and will contest any court action.
This has had zero effect and I continue to get letters, most recently claiming that they are preparing a court action against me. The woman I spoke to tonight on the phone to BCW was incredibly rude and unhelpful, hanging up on me (i hasten to add I am not the shouting screaming type and i remained calm and reasonable at all times)

So what do I do? I have looked at various solicitor's websites but they all seem concerned with injury compensation!
I really think that BCW and Thames credit should be called to account for what is basically harrassment and Lloyds for passing on charges that they knew to be illegal, to debt management companies.

Thanks in advance for any advice you might have!

Regards
Ben

Its a tough one but what you could do is although the debt has been placed with someone else you could always go to Lloyds & claim the money via the methods on here. You are technically in arrears with them due to the fact they probably slapped £30 here & there on your account cos they felt it was ust, your account will still be open aslong as you owe them & they will be able to provide you with the statements. Its kind of a counter claim but its the best way forward in my eyes, I could be wrong & someone may have a brighter idea. You could always contact the FO & get them involved or even give them a call to see what they suggest.

The only sumbling block I see is that Lloyds may try say you dont have an account but I wouldnt have thought they will say that if you owe them cash.. so its not really a stumbling block!

    Hope this helps :)

  • Thanks very much for your reply Garath

I will call FO tomorrow and see what they say. I think it is catch 20/20 for Lloyds because even if they say I dont have an account then i can still claim back charges going back 6 years and they probably dont want that :)

Have you tried to reclaim the charges back from TSB?

If you havent I would do this and in the meantime I would write to thames Credit stating you will not be paying as the account is currently in dispute.

    Hope this helps.

easy peasy....let them claim against you...then you can submit a counterclaim with your defence..
