PE POPLA Appeal

This is my first time posting here but not my first time tangling with Parking Eye, or using this forum's (excellent) advice.

Recently my significant other got herself a PCN from Parking Eye, for parking in the Crown Wharf Retail Park, Walsall. She didn't pay for parking (mistakenly thinking it was after the time she needed to pay) and stayed for nearly 3 hours at a restaurant on the retail park. We then received a PCN from Parking asking us to pay £85.

I attempted a soft appeal (which had previously worked for me at the same car park when my significant other over-stayed her parking), but this time PE have rejected the appeal and sent me a POPLA code, along with a 7 page justification of their position, and Annex with a list of (old) court cases and a statement that:

"as you can see no Judge has ruled against Parking Eye on this matter".

Hmm... I believe that to be a lie, as the last case they list is 28/08/2013, so hardly recent.

As for the point of this post: I am now at my POPLA appeal and have 21 days left on that appeal, and would like to know if the letter to POPLA applies in my case? Obviously I need to alter for my circumstances, and particular car park etc. I would also like to know can I appeal if the driver did not pay for their parking? Or am I on a hiding to nothing?

    No 'hiding to nothing' applies on here as long as you use our wording. We win 100% of POPLA appeals and PE now give up when they see our words. Read the NEWBIES thread:

    Post #3 tells you how to win at POPLA with links, and post #5 includes a link to all the recent court cases WON against PE! Not that you will need that, but you might want to look and laugh. Submit the POPLA appeal once you are sure you have the usual words ('no GPEOL' and 'no standing' and 'unclear high/unlit signage in a car park shrouded in darkness' etc., see the NEWBIE thread), then you may want to also send a complaint to Trading Standards locally at your Council that PE are lying about their court win % and you can show all the losses we know about (lots!).

    If you want 2nd opinion on your appeal letter, post it up first, although you seem very clued up.
