Apologies for not opening a new thread - will be happy to if directed.
That's a good start and thankyou for NOT starting a new thread which drives us mad - otherwise how can we glance up at your first post to find our the background to the POPLA appeal? Posting it here on your thread is exactly right, sop much easier to look at the whole picture.

Some of that template is a bit old though as VCS v HMRC is not relevant and also the no GPEOL paragraph we suggest now, (point #1) has more nowadays! I have just removed that version this minute, from the NEWBIES thread and instead I have just linked THIS one (linked below). SEE POST #15, THE FINAL VERSION and decide whether or not you want to leave in the slightly rude dig at VCS that the poster mentioned in post #16!

That one is much newer and quotes POPLA Assessor Chris Adamson debunking VCS' attempt at showing the charge to be a GPEOL. So it puts you a step ahead for when VCS send that 'evidence' and stupid non-genuine 'GPEOL' statement to POPLA, you'll have already refuted it!

Obviously read every word a few times and remove/change anything that's wrong in your case such as maybe this sort of thing which might be only relevant to that other poster, not all cases: 'In addition, VCS have admitted that they "are outside the delivery timescales for maintaining [their] rights to keeper liability", rendering this PCN unenforceable.'
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Dear coupon mad - thank you for your input. I have read the draft you recommended and taken out the sentence you mentioned as it doesn't apply to my case. Otherwise I would be keen to use the remainder as it is an identical case.

    Once again thanks very much
