Restrive covenant on ex-council house against garden sheds

    In the 1950s council houses were built with a range of brick outbuildings so that the tenants didn't need to erect their own sheds.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Councils can't even seem to deal with the 'sheds with beds' popping up in certain london suburbs. So hopefully your little timber she'd is not going to be an issue!

    It's a shed. Couple of hundred quid tops. Put it up. If the Council objects (and I'd bet my house they won't) take it down. Simples. Why go looking for trouble?

    There is probably not too much I can add as quite a few posts already covering a range of matters.

    However there are a couple of points which may help in some small way

    I suspect the housing officer was most likely to be thinking along the lines of planning requirements, which can come into play with sheds over a certain height. 8 x 6 is I assume length and width so if over 6ft high as well then that may have set him down the route he chose.

    As others have mentioned the issue of the new shed and/or the rest cov would not be one that housing would normally be involved in and the legal dept would be my first port of call and if not then planning to at least understand the wider issues which may exist.

    The advice on rest covs seems reasonable and I would always recommend legal advice if only to understand the possible risks involved in any breach.

    This type of rest cov will often be mirrored on adj properties so they are often a good indicator as to how others have viewed such risks providing of course that they knew that they had a rest cov in the first place.

    In the circumstances contacting the Council to seek permission seems the right way to go as that is what the rest cov requires. It may also be useful to know what options are available should they say No of course but whether you consider that now or after their response is your choice of course.
