Book Your Theory Test

My 17 year old son inadvertently booked and paid £49.50 for his theory through this company online on 31st January 2014.
In know he should of gone through the dotGov site but he didnt.
It became clear that this was not the most efficient way to do it and a little research showed that although not a 'scam' as such, they had been fined and its reviews offered some insight in what was to come, they had already been fined £60 000.
We had outlined at the start that due to his work commitments it would need to take place on a Wednesday.
We waited and waited and after numerous emails on the 17th February 2014 we received the following.
Thank you for your email. I have escalated your email onto the booking department as a matter or urgency who will hopefully resolve the matter as soon as possible and forward a copy of the confirmation email onto your email address again.
Finally we received an email on the 21st February 2014 giving a date for the 7th March 2014 which was a Friday
I replied immediately to say that we had already made clear that Wednesday was the day that needed to be booked.
More emails without response and I find myself wondering if it is worth going to the small claims court.
If you could offer some informed views that would be most appreciated, please do not reply just saying he should of booked through the dotGov site, this is already clear

My advice would be to raise a chargeback with your bank for services not received.
If the company give you another date that is unsuitable, you should be able to contact the DSA and change the date.
If you log in online here https://www.gov.uk/book-a-driving-theory-test then it should tell you about any previously/currently booked tests etc.0 -
