Jsa question

Hi all,

I recently started a job after being made redundant about 6 weeks ago. It's a driving courier job and when I was offered the job I was told the salary was £18000 which I was happy with. What I wasn't told and what I didn't realise is I will be working 6 days out of 7 and 60-70 hours for that.

I have done a week and it's very stressful and I feel absolutely shattered, I'm thinking of giving it a few more weeks to see if things improve but if I do feel the need to leave will I still be able to claim jsa?

    Yes I am over 21, which explains why I was told the salary is £18000 per year and there is no hourly rate.

    Would the fact that I am being paid less than minimum wage be a valid reason for leaving?

    What is actually in the contract re working hours - is the job exempt from the working time directive? (48 hours max per week) do they pay overtime?

    I am sure that working for 4 days straight (you said in your other post you did a trial day on Monday so assume you worked Mon-Thurs when you posted this) after 6 weeks off will be an initial shock to the system but would get better.

    If you leave voluntarily you could receive a sanction for up to 26 weeks however if there are unfair terms - eg must work 60 hours per week, no overtime payment, under minimum wage, you may find this is reduced or no sanction.

    It usually seems easier to get another job whilst you have a job so maybe keep hunting and look to get something else lined up before leaving

    Here are the regulations about being sanctioned for leaving a job (JSA)

    The relevant part about leaving a job is from 34426 onwards.

    In the end it is only a Decision Maker who can decide.

    Not paying the NMW/misrepresenting information (have you signed a contract - look at it carefully to see what you signed) etc will all be looked at. BUT

    They will have expected you to try to resolve this with your employer and have evidence that you did so before you resign.

    All in all best to stick it out for a while and see exactly you are required to do and whether any laws are being broken/contract is illegal.

    Many thanks for the valuable advice, I'll give it a few weeks to see how things settle down before I have a word with the boss.

    Regarding the contract, I haven't signed anything yet but I have an induction tomorrow so I guess I will learn more then.
