Reclaiming Policy Excess / Non Fault

Is there a way to reclaim the policy excess even though it wasn't the drivers fault?

Today a pedestrian stepped off the curb and my partner couldn't avoid the collision. The incident is recorded on CCTV. Police & Medical crews involved.

Car is now at the garage awaiting repair but we will be billed for £350 for excess :mad:

    Apart from sueing the pedestrian, not as far as I know

    There is a scheme were if an uninsured driver crashes into others the insured doesn't foot the bill. Surely there should be similar scheme for 'jay' walkers causing a crash that comes out of the public kitty.

    Crashes by uninsured drivers are paid for with a surcharge on all policies.

    The guy that was hit is liable for damages - whether you want to pursue it or not is up to you.

    Your insurance paid the bill - so you pay the excess.

    If you want not to pay your excess, then you need to find somebody for your insurer to pass the bill to. That would probably be the pedestrian.

    Have you got legal cover included with you insurance? Years ago we had a contested claim - other driver reversed into us then tried to claim we drove into her. Handed the whole lot to the legal people included with our car insurance, they recovered all costs - but it took a year.
