Question about the £10 Charge

I have a question. I am one of these sad !!!!!!s that keep all their statements so when i claimed against lloyds on the 20th of June i didnt need my statements so i received a letter this morning from them saying that they are sorry im not happy with the charges blah blah blah and then they went onto say that
"If you have asked for copy statements and paid the fee, we'll send them to you within the 40 day limit set by the Data protection Act. If you have not yet sent the £10 fee you will need to send it to us at the address below. The 40 day limit starts from when we recive your payment."
Then they said "I hope this fully answers the point you raised with us. PLese let me know if there is anything else i can do to help. If we cannot come to an agreement, i will provide you with details of the Finacial Ombudsman Service so they can consider your compliant indepentdently. If you are happy with the way i have dealt with your comlaint, there is no need for you to reply to my letter. If i have not heard from you by the 24 August i will close my file."
So at this stage should i send martins second letter saying i'll take them to court?

Yes, if you know your charges, list them out and send the initial approach letter.0 -

I would also explain that you didnt need to ask for your statements as you keep them anyway so had no need to send £10. Id be sarcastic & say please respond to my letter personally in future rather than a generic response
