Previous company overpaid and now asking for their money back

  • So, wheres your proof of what contract you are on? If you have it then copy it and show payroll/HR.

    If you have no proof....very hard to do anything about
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    I'm confused by your post, are you saying you now don't owe money?

    You're unlikely to achieve anything unless you can approach the people involved calmly, rationally and politely.

    I owe them the day's wage they overpaid me, they owe me £105 that I have earned but not been paid.
    You're unlikely to achieve anything unless you can approach the people involved calmly, rationally and politely.

    Sorry, I am venting on here, so getting angry! I haven't been rude/impolite to anyone I have spoken to so far.

    Did you sign a contract? This would be the logical place to start.

  • Do you have a copy of your contract? If not your (original) employer will have one that you signed. That will state how many hours a week you were contracted to work.

    Do you now think you worked hours that you have not been paid for? If so you should contact your previous employer with dates you worked and copies of payslips. Make sure your figures are correct, don't include unpaid breaks etc.

    Check the contract details held by your new employer. Obviously if is a thirty hour a week contract they are not obliged to offer you any overtime.

    They come back to me and I then discover this:

    I was employed on a flexi-contract of 30 hrs/week!

    What. The. F**k?! :eek:

    This was news to me. I NEVER would have taken a job that was only offering this type of contract!

    They then went on to explain what this contract meant:

    30 hrs/week plus any additional 'fexi-time' paid as overtime.

    So, the 5 hours a week I had been missing, when I did complain, got paid to me the following month as overtime!

    I told them I was not once made aware of this and my manager had offered me the position of full-time receptionist at 35hrs/week.

    I got this response:

    It is IMPOSSIBLE for your manager to have offered you this type of contract. Flexi-contracts are only able to be between 5 hrs-30hrs/week. He could not have offered you 35hrs.

    The Payroll are unaware that you were offered 35hr and only have my word to go by, therefore they can do nothing but process and pay the hours I am contracted to do.

    I was then told it wasn't their problem and to take the matter up with HR.


    SERIOUSLY?


    I am beyond furious about this!



    Again, you're not thinking about this logically, but emotionally.


    You will not solve a problem by creating a problem.
    PAY THEM the money back, then RAISE A SEPARATE grievance with the company for the time you are owed.


    As has been pointed out to you and as you should know already had you thought about this situation, in a large company, no one person controls the money.


    One team pay your money, another team may handle issues with money owed.


    They work together for the same organisation but they will only co-incide if a case is raised to them.


    So do this properly and pay them the money they think you owe them and then raise a case to get back the money owed to you.


    If you do this one step at a time you will get there in the end.


    Did you not read the contract you signed? I presume you just signed it willy nilly. In which case it will your word against his IF your contract states flexi hours. You could always ask for a meeting with him and see whether he lies to your face or agrees he made a mistake and handle the situation. Buuuut I doubt it will be easy sailing cos you seem like a bit of a bunny boiler who han't a clue.

    I have contacted ACAS, who advised me to raise a grievance against my former company (I have 3 months to do this) in order to claim the money I am owed. If the do not respond to my complaint within 14 days I can contact my previous employer to inform them I will be taking the issue further with ACAS.

    I am currently in the process of gathering my evidence against them. Security have given me a print out of all my ID badge usage (it detects when you enter/exit the building) as my ex - manager wouldn't let me have access to our sign in sheets.

    I have dug out my contract and it doesn't state how many hours I was contracted to do. I never received a formal letter offering me the job, only an e-mail from the head receptionist, which I have printed out as it states I'm being offered a full-time position.

    I'm hoping that I will now get the money back I am owed (minus the overpayment they want back). I'm not "bunny boiling" or purposefully causing trouble. I deserve to be paid for the work I have done. If this means my manager gets the shock that he needs to start being a better manager then that can only be a good thing!

    As I mentioned before I was angry, upset and venting on here. I haven't been rude to anyone at work and don't intend to be!

    I'm sure you would feel the same way if you had been lied to and treated this way by your employer.
