Previous company overpaid and now asking for their money back

They HAD been underpaying me! 5 hours a week to be exact.
Although I was working (and contracted to) work 35 hours a week, I've spent the last 6 months only being paid for 30 hours per week!
I realised this when I got my second payslip (first payslip was for 6 weeks work so didn't notice straight away) and went staight to my manager. He said this must of been a typing error made by the payroll when processing my details.
I was losing around £150 per month because of their "typo" :mad:
This has only just been rectified! I was complaining to my manager every month and even went above him to speak to HR/Payroll myself.
Now I owe them some money they expect it right away! The cheeky B*****ds! I've ended up in debt/had money taken from me by student loans etc which shouldn't have been all because of them!

Losing £150 per month when your employer can't pay you correctly? I think that justifies a bit of drama!
As I've previously stated, I'm willing to pay them back, but I can't just hand over £45 like that!
I've attempted to make a formal complaint/file a grievance against said company but as we have TUPE across to another company there is nothing I can do
I wrote my manager a letter of complaint and handed him/his manager a copy when we left and haven't had so much as an apology from them!Do they owe you any pay like holiday pay for acrued unused or are the new company taking over the holiday liability
The new company have to take all responsibilities from the date of the TUPE - including any grievances (which they have done). It's my former company that are being so unhelpful

Just pay what you owe and move on with your life.

They overpaid and now they want their money back, hardly unreasonable. The longer you stay angy and upset with them, the longer YOU'LL feel angry and upset, your anger is no skin off their nose.
Have you actually seen the letter? When do you have to pay it back by? Honestly, if it was me, I would just pay it, if only to be done with them. I would however, double check how much tax and NI you've paid, you might be owed a bit back from HMRC.0 -

I will pay the £45 that they have overpaid me, I don't want to risk being taken to court.Ultimately, they have corrected your underpayment so that issue is now moot.
As for my pay being corrected, I know it's been dealt with, but I've still ended up with money problems as a result of their incompetance

When I was at college I had a part-time job working weekends in a supermarket. After I'd left and gone to uni, they sent me a letter stating I had taken holiday that I wasn't entitled to (I had no idea this had happened as all my holiday had been authroised by my manager) and owed them £20. It was their mistake.
I ignored the first letter and they came back with another saying I would be taken to court if I didn't pay. I was a student with little money at the time so I didn't pay them back (especially as I saw it as their mistake, not mine).
They never took any further action.
Under normal circumstances I would just pay them the money as it was a mistake, but I feel so angry about everything that my previous manager/company have done I don't want to! They have gotten away with being so incompetent it's unbelievable!

So this has happened also with a previous company who you think you've got away with it!! Don't be under any illusion that they written the amount of!! They can still pursue you up to 6 years after the debt was notified to you!!!0 -
This. Take your overly emotional aggressive immature attitude out of this situation. Stop blaming the world for the way you have been treated. You could have left if you felt the treatment was bad.Stop with all the dramatics and pay what you owe!
How about you stop thinking about yourself for one moment and flip the scenario on to yourself. You've overpaid someone and you want your money back. How would you feel if you were not receiving the money you were owed?0 -

As I mentioned previously, I HAVEN'T BEEN RECEIVING THE MONEY I WAS OWED! My company have been paying me incorrectly since the day I started working for them! :mad:
Last night my OH and I sat down with all my payslips and did a spreadsheet to see what I was paid vs what I should have been paid and it turns out I've been underpaid by £105 at least! (we didn't include overtime).
Today I contacted Payroll Services to explain that I would be happy to return the money I owe them for overpaying me, however I wished to raise a grievance, as I could prove they had underpaid me throughout the 6 months I worked there before the TUPE to my new company.
TBF to Payroll, they were understanding of the situation and put me on hold to find out why I had only been being paid for 30 hrs/week on a 35 hrs/week contract.
They come back to me and I then discover this:
I was employed on a flexi-contract of 30 hrs/week!
What. The. F**k?! :eek:
This was news to me. I NEVER would have taken a job that was only offering this type of contract!
They then went on to explain what this contract meant:
30 hrs/week plus any additional 'fexi-time' paid as overtime.
So, the 5 hours a week I had been missing, when I did complain, got paid to me the following month as overtime!
I told them I was not once made aware of this and my manager had offered me the position of full-time receptionist at 35hrs/week.
I got this response:
It is IMPOSSIBLE for your manager to have offered you this type of contract. Flexi-contracts are only able to be between 5 hrs-30hrs/week. He could not have offered you 35hrs.
The Payroll are unaware that you were offered 35hr and only have my word to go by, therefore they can do nothing but process and pay the hours I am contracted to do.
I was then told it wasn't their problem and to take the matter up with HR.
SERIOUSLY?
I am beyond furious about this!0
