Santander ppi

Options
Hi

I had a mortgage with abbey from 1982, I was 23 when it was taken out and very naive pretty much signed anything, I stayed with them through the term of the mortgage, the mortgage was paid off in 2009, I queried the PPI personally and they have come back admitting mid selling however only offering me £124. My question is if I've had payment protection that was mis sold for 25 years how have they arrived at a figure of £124. Is there limit how far back I can claim? What questions should I be asking them

Clearly, they only have records of you paying £124 PPI. If you have evidence to the contrary, you can refer your complaint to the Ombudsman.
  • Their stance with me on credit cards is the Data Protection Act requires them to keep data no more than 6 years so unless you show evidence of what you paid and when from they wont pay you and they wont pay you prior to the earliest statement you find.
They claim it wasnt company policy to charge PPI for everyone on credit cards unless you opted out .. but I know it was. I just cant prove it.
They do say to me that they only issued opt out letters to loan accounts so thats probably how you ended up paying it. They must know when that was.

This is truly not a "stance". The Banks do routinely destroy records no longer required after six years. They may still keep records of start dates of finance etc, but the minutiae of payments made are usually not kept, especially for closed accounts.

Of course, destruction of old records has become much more thorough in recent years precisely because of the PPI debacle.

In 1982 it would not have been Santander. You say it was Abbey National but the same applies to, Alliance Building Society, Leicester Building Society, National & Provincial Building Society, possibly Bradford & Bingley or maybe somebody more obscure like the Horsham or the Hastings & Thanet.

You have a problem, though, because Santander submits to the jurisdiction of FOS in respect of an institution it has taken over or "inherited" if at the time the predecessor was a member of an Ombudsman scheme that FOS has now taken on responsibility for.

FOS has taken responsibility for the Building Societies Ombudsman but that only came into existence in 1987 - five years after you took out your mortgage.
