Help? Erudio, student loan and CCJ?

Wondering if anyone can help, my husband is registered disabled and only income he receives is Dla. When I moved in with him a couple of years ago he used to pay £20 a month to his student loans despite being under the threshold of what you are supposed to earn. I found letters from lawyers when I moved in which were instructed by Student loans companies to recoup the money. I called SLC and advised them of the situation that my husband was disabled and wouldn't get any better (he is now 55) and they advised me they didn't think under the circumstances he would have to make repayments etc, they said they would look into it but with the new info I had given them it was likely that would be it sorted. Never heard another thing from them and no lawyers letters when we stopped making the payment but we have today received a letter from eurido and it says there is already a ccj in place regarding my husbands loan!????? Please help me

Check the registry trust to see if they are telling the truth. http://www.trustonline.org.uk/ If they are, contact National Debtline.

Decrees in Scotland are recorded on the registry trust as well AFAIK.

Could it have been at a previous address of his? Sometimes they don't link up previous addresses on credit reports properly meaning a CCJ could exist without currently showing. Ultimately, if Erudio insist there is a CCJ demand that they give you the court name, date and reference number so you can check with the actual court.

  • Thanks for getting back to me, always been at same address.and nothing at all on.his credit file/report. I think they are at it. Also were the loads not supposed to be wiped after u reached a certain age? Besides.the fact SLC advised me due to disability he would unlikely have to repay anyway

Is is complicated as there are possible write off due to age or time since you took out the loan, or on certain disability grounds. Unfortunately those do not all always apply if you are behind on the loans, have failed to defer or have had a CCJ or other action taken against you.

Hard to advise for a forum thread, so I would suggest contacting National Debtline on freephone 0808 808 4000. They should be able to help, or refer you onward to somewhere that can get to the bottom of what is happening in your case.
