UKPC Parking Charge - Dundee

Good Morning All,

I’ve read through all the forums for info but I’m slightly confused so thought I’d chance my hand and post here, hoping that my questions could be clarified....

I received a parking ticket yesterday at Dundee’s Gallacher car park for failing to display a ticket – ticket attached to my car windscreen when I came out of the shops. As I'm not from Dundee I didn't know that it was pay and display. I'm from Scotland btw...

As my car is a company car, what is my first step? Do I contact my car fleet manager and advise them it’s a private matter and not to pay on my behalf? Or, shall I contact UKPC directly confirming that I was the driver.

If I am to contact UKPC shall I do this in writing or through their website?

    As it is a company car, then yes you need to "appeal" to UKPC to confirm you as the Keeper.


    Then as this is Scotland, you studiously ignore everything they send you - There is no POFA or keeper liability here, so the chances of anything beyond a series of threatening letters is minuscule - and they can't go back to the company after targeting you. See the pre-POFA letter chain thread for a fair idea of the rubbish they will send you over the next few months.

    I would suggest you write, keep copies and get proof of posting, just in case.

    I'd write back to them that you are the 'Keeper' of the car (note, not the Registered Keeper) and you deny any liability. Do not confirm who driver was - you are under no obligation, especially in Scotland.

    Anything further that comes your way can be ignored.

    (Any NEWBIE reading this, please note that this advice applies only in Scotland and NI. In E/W it is a completely different scenario).

    Get a certificate of posting? Yes

    Appeal as the Keeper (not Registered Keeper)? Yes

    Use something like this as your appeal ...
    Dear UKPC,

    PCN number xxxxxxx
    As the usual keeper, I have received your parking invoice from the driver on the day which, of course, I decline your invitation to pay. I wish to invoke your appeals process, since all liability to your company is denied on the following basis:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with your ATA Code of Practice and was not sufficiently prominent to create any contract
    3) You are not the landowner and do not have the standing to offer contracts nor to bring a claim for trespass
    4) This is Scotland and the Protection of Freedoms Act 2012 does not apply, thus there is no keeper liability and only the driver may be pursued (and I am under no obligation to identify the driver).

    Accordingly I suggest you cancel this charge forthwith. Any communication other than confirmation of cancellation will be considered harassment and may be pursued accordingly through the courts.

    Yep give them your real name and address to hook the letters to you - there's a UKPC Northern Ireland thread on here right now which has links & info about the usual debt collector letter chain (DRPlus and Zenith letters will come your way). Have a look at the NI UKPC thread near yours now.

One was through the post from Debt Recovery Plus for £100, and the other was an email from General Finetime Mtombe of the Mozambiqean Army promising me £35 million dollars if a gave him my bank account details and met him at Heathrow airport to open a safety deposit box left by his great Uncle before the armed conflict. Both different, but strangely both the same. And both funny.

    Why not give General Finetime Mtombe DRP's email address and tell him that they are dealing with all your financial affairs and you have instructed them to help him in every way possible.
