check whether your EA agreement is "sole agency" or "sole selling rights". With sole agency you only pay if they introduce the seller, sole selling rights and they get the commission whatever.
We sold our house to someone who put a note through the door, the EA never argued with that even though the people were on his mailing list (he hadn't yet done a mailing, though we had signed contracts). As he had behaved correctly we made sure any house for sale on multi-agency terms we viewed through him. We did end up buying through him, so he did gain some commission in a roundabout way.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. So the peole who u are selling your house to have htey had there survey done yet? Do you not feel its a little unfiar on the buyers who may have already spent a lot of money on proceeding with the sale?0

Sole Agency. No survey as of yet. The offer was only put in and accepted a week ago. I would even consider reimbursing them the cost of the survey.0

If it is on a sole agency and the neighbour wasn't introduced via the EA then you will not have to pay the EA....even if they have a buyer........it's a little unfair but if that's your decision.....My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to sayIgnore......check!0 -

Well that is ok then . The only reason why i ask is that for the flat i am buying it was practially a survey race (whoever instructed the survey first got the flat). So i assume this is not the case with yours! Its nice that you are offering to reimburse survey costs as well very thoughtful.

Take the best offer. Stuff the agents, they would act the same way towards you. As for your other potential buyers, everybody knows the risks in the system in England, so may the best offer win.Signature on holiday for two weeks0
