Holiday abroad?

Hi all.

Out the blue my parents have asked if me & my Daughter would like to go away with them for a week abroad to their timeshare this year. This shall be all paid for by them including the car parking as I shall be returning after a week while they stay on.
Before I get to over excited by this offer I was wondering the following.

  • Can me & my Little one go abroad with me being a Undischarged bankrupt? Would it be best to ask them to put this off till next year?
  • If I can. Do I need to inform the OR?
I must say it feels wrong for me to except & the timing isn't great as people may view this as being wrong & unfair while being an undischarged bankrupt.
They did the same for my sister & her family a few years ago as a treat & as my daughter is older now they wish to take us away the same.

Your views & opinions are appreciated as always.

Being BR does not place any restriction on travel as far as I am aware? There is no one you have to tell as far as BR is concerned - the OR would only be interested if you had a secret stash of cash somewhere that was paying for the holiday.

    Hi Gardener.

No secret stash of cash or pot of gold at the end of the Rainbow for me I'm afraid. Parents are paying for all as said & can be accounted for if needed.
But your comment is exactly why I asked the questions.
Should/Do I need to inform the OR of this?

This is a gift of a holiday not cash, therefore no reason why the OR would be interested as far as I can see. It's up to your parents what they spend their money on and as they are not BR (I assume) they don't need to explain this to the OR.

Go on the holiday and have a lovely time with your family.

    Hi macbabypam.

That's exactly what my parents said. Any other time past or present I wouldn't have given it a second thought. Its feels wrong that while I'm an Undischarged Bankrupt that I should be allowed such a gift.

    Hi Noodles

No issues from where I'm looking, assuming the OR won't have any urgent need to contact you in the time you are away.

There are no restrictions on people being kind to you during your bankruptcy. That is how I would look at it, so enjoy your holiday - it is not to the detriment of your creditors.

  • You're allowed to have a holiday fund anyway in your SOA if the OR agrees, so even if you were paying your own holiday from your income there isn't a problem.
    Enjoy!

    Hi Dennis.
Only spoke with my OR 3 times at the most & that was 6+months ago when I declared myself Bankrupt so not expecting any urgent calls.

    Hi Woody.
I've not accounted for a Holiday allowance in my SOA as just don't have any money spare after all out goings for this. But this has brought on another question. Can I substitute what I would have spent on food & fuel at home for this week away for spending money on Holiday instead?

Once your SOA is agreed, you can spend the money how you want. For example, if you have been allowed £600 per month for food and only use £480 the extra £120 can be put towards other things you may want/need. Same applies for clothes, just because you are allowed X amount doesn't mean you have to spend that amount every month on that expense.

Thats my understanding from reading various posts on this forum, someone with more knowledge can shoot me down for being wrong though :)

Yes, certainly there is no problem at all with that. How you manage your money is entirely up to you.

You don`t suddenly become Interpol`s most wanted because you went bankrupt.
    Enjoy.
