Another BPA Whitewash

A car parking company placed under investigation by an industry watchdog following a complaint by Bradford Council has been cleared of any illegal behaviour.
West Yorkshire Parking Enforcement (WYPE), a private company based in Bradford, was reported to the British Parking Association by the Council in January for allegedly issuing parking tickets without appropriate warning signs.
Although cleared of using illegal signage, the company is now said to have agreed, in conjunction with the Council and the BPA, changes to where its signs are displayed across various city centre sites.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Because heaven forbid they actually expel a member and lose their membership fee (and risk having them go to the IPC instead).

    But the IPC have said they won't accept any members who use a GPEOL business model. ;)

    Hang on, surely it is not up to the BPA to rule on the legality or otherwise of notices concerning consumer contracts, that is for the Magistrates if a TSD issues a summons.

    Has the paper got the wrong end of the stick? I expect that the Council complained about the signs breaching the BPA's Code of Practice, a different glass of Chardonnay altogether.

    That will be because in their own pathetic little minds the BPA actually believe they are a regulatory body rather than a tin pot trade association which is the reality. You only need to read the tweets from their equally unimpressive Communications Officer David Smith to realise how deluded they are.

    And why should we accept the word of one trade protection society over the other?

    Sussex Security Solutions t/a Parking Enforcement (an IPC member since its inception) have just lost an appeal sent to the IAS by a recipient of one of the PCN's. Why?

    Well, because their charges are based on GPEOL.

    No sign of their being expelled and given that prospective members have to bare their soul to a slightly greater degree to the IPC than those who want to join the BPA Ltd one wonders why they were allowed to join in the first place, if the above were true?

    It couldn't possibly be another example of old boy's club doublespeak, could it?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    If you complain to BPA Ltd. about a dodgy landowner contract the stock response is "we're not lawyers and we don't give legal advice to our members". And yet now, by some miracle, they are qualified to investigate alleged criminality?

  • I complained to the BPA Ltd about this outfit before they joined the BPA Ltd ATA.

    My complaint is below:

    "Dear Steve

    I enquire about the Yorkshire Parking Enforcement Service which proudly displays the BPA Approved Operator logo on its website.

    I also attach a screenshot for your information.

    I note that the website promises:

    "•YPES Ltd will act at all times within the guidelines set out by the DVLA in relation to the removal of vehicles. The removal of vehicles will only be carried out by SIA registered and licensed operators."

    "YPES Ltd are British Parking Association ‘Approved Operators’. As such we undergo a rigorous yearly audit by external assessors. We are Information Commission Office registered (ICO – Data Protection Act) and qualify for an electronic link to access Owner/ Registered Keeper details from the DVLA."

    "YPES Ltd is a professional and ethical operation that offers a complete car parking solution. We provide our customers with
    a proven and effective method that’s eradicates unlawful parking in a non-confrontational and legal manner."

    "•YPES Ltd offers a total debt collection service. We allow 10 days for the fine to be settled, if after this period the driver or the keeper of the vehicle has failed to pay the fine. YPES will obtain the vehicles licensing and keeper registration details
    from the DVLA and pursue the debt through the courts."

    "•During this process we adhere to the BPA’s code of conduct and the Data Protection Act."

    Would you please explain under what legislation this "BPA AOS member" issues "fines", undertakes removals, has access to the DVLA electronic link, to combat "unlawful" parking?

    If this is, however, just another cowboy parking company, does this not prove that the BPA AOS logo displayed on signage and websites does not guarantee any kind of proper behaviour from the Private Parking Industry.

    A few days later, the BPA Ltd allowed this company to join their ATA. This shows the BPA Ltd's so called standards.
