Bank Holidays and part time!!

Hi!

I am working part-time form Tuesday to Saturday (21 hours per week).

According to my contract I have 25 days annual leave plus bank holidays (all pro-rata), however my manager is telling me that because I am off all Mondays, they only give me Bank Holidays when they are not on Mondays, I mean, this year I´ll have 25 days annual leave plus bank holidays which are not Mondays (less than 8).

Is that fair?

I do not if I am making myself clear.

    28 days plus bank holidays pro-rata is quite generous for a part-time position, so you should probably check the wording of your contract

    No, it's not right or fair.

    I used work similar hours and was also off on Mondays. My leave = (full time worker's leave + all bank holidays) divided by 37.5 (full time hours) x 27 (my usual hours).

    So in my case the calculation was (28+8) / 37.5 x 27

    Whenever I took a bank holiday, 7.5 hours (a normal working day) were taken off my leave allocation.

    "Your normal hours of work are 70 hours per 4 weeks, arranged across Monday to Saturday"

    Everybody has two days off per week

    I am working 84 hours per 4 week from Tuesday to Saturday.

    I have 25 days of holidays.

    Right. Clear as mud!

    I've no idea exactly how many days I had (changed to full time since then). I checked the calculation when I started the job then didn't really think about it apart from struggling to 'use up' leave at the end of each year.

    My contract says one thing, I am working other time, the only point I get is they are taking advantage of me because English is not my first language, and when I talk to my manager she is not clear at all.

    That's a bit of an assumption isn't it? If you don't understand something then ask for it to be clarified - in writing if necessary.

    Don't assume that your manager is purposely being unclear - remember that you have to take some personal responsibility for successful communication as well.

    Part timers are entitled to the same holidays a full timers on a prorate a basis, if they work 5 equal days then that's the same holidays as a full timer.

    if the normal holidays is 25+ BH(8) then that's what you should get prorata.

    If you work variable hours the easies way is to use hours as your contract is hours

    70 hours over 4 weeks/20 days is 3.5 hours per day on average.

    As you work 5 day weeks you should get the full allowance.

    If you are constantly working more hours get the contract changed to include those hours.

    Get it worked out in hours its the only way. I have some horrible spreadsheet to work out my leave allownace (that I can book myself) as we have both bank holidays and closed days (as its a university) and I only get three-fifths of any of them being 0.6 contract.
