Repo Flat - how to check Parking?

Hi - How do I find out if the repo flat i am purchasing comes with parking?
the agent claims it doesn't; the management company claims the flat is associated with a parking space.
do i ring the management company and verify whos name the lease of the parking space is under?
at which point with solics know this/what do they need to do?

Examine the flat's lease.
If the parking space is on a separate Title & Lease, examine the lease for the space (and make sure the 2nd lease is included in the sale).0 -

so i'm in the early stages and haven't instructed a solics as yet (will do monday)
i've been given the flats lease - no mention of parking - I think the parking spaces tend to be on a seperate title/lease.
how would I get the lease for the space?
in terms of ''being included in the sale'' - this worrys me in the sense that the bank may have stripped it out of the sale. I'm new to this with no legal knowledge so please forgive me. The agents mentioned that parking spaces for flats don't tend to come out until solics discussions - they advised it may well have parking but since seem to be steering 'no parking'; despite the management company stating that the flat no i'm securing has parking associated with it.
basically i'm confused..0 -
the lease does reference "car parking service charge" and "car park proportion" but i don't think this sheds any light and is purely on the definitions page.0

Is this a dedicated parking spot?
Or perhaps an undergound car park where it is first come first served - hence perhaps service charge for an access gate etc?
If it is a dedicated spot on a separate title (unusual), you could do a map search at the Land Registry and try to identify the right one, then download the title (£) and see if the owner is the same as your seller.
Is there a Plan attached to the lease?0 -
its an underground parking slot common with alot of new-ish builds in manchester (2005 build). Having viewed brand new (similar propertys) they often sell parking seperately if you do not want to fork out the extra money (i.e. you can buy the flat with or without the car parking slot/they may sell the allocated spot elsewhere).
The agents mentioned that if the bank new that there was parking associated they would look to increase the list price.
I don't understand how it is common for neither the bank nor the agents to know whether it was parking. When I told the agent the management company advertised the flat 'had parking'; they said
1) they were acting on the premise it did not have parking
2) the management company is unreliable.
3) but it is the highest spec in the building.
so i'm confused and up against the clock in terms of completing.
I can't actually find the property on that land registry search; it doesn't seem to be where it should be.
can i obtain the car parking lease from the management company free of charge?

UPDATE: flat lease does have a basement/car parking plan on but no section 'circled' for parking on this lease.

If the lease you are buying has no mention of car parking slot being included, and the Lease Plan does not highlight a slot, then it would appear there is no parking slot included in the sale.the management company claims the flat is associated with a parking space0

There is the possibility that the owner had a parking space but the bank didn't have a charge over it - in which case the bank wouldn't be in a position to sell it to you.
But I'd normally expect the bank's solicitors to be able to answer this sort of basic question from agents, rather than leave it as a last-minute surprise.0 -
cheers - i have instructed a solics and they are more than aware of my concern.
i was just trying to do as much investigation as possible.
my solics opinion is that there is parking; but no space allocatedl; its first come, first serve. It references paying general car parking charges and one must ''not park elsewhere other than the Parking space" - now the assistant said this was vague. The car parking slot is attatched but no plot highlighted but the actual lead on the case said she believes it does have parking; but no space.
now i dont think this situation is possible. I phoned a guy on gumtree renting his space and he claims that to have a fob to the building; all fobs are tied to a specific space. With 60 odd spaces for 98 flats; i can't imagine any 'first come, first serve' type agreements.
Hopefully my solics will sort this and request any additional leases from the Manco..0 -
also... Day 1 didn't go well, lots of details were wrong and the solics has tried charging me an extra £100 (190) for lang registry despite me going through FridaysMove who have promised a £90 lang registry fee (due to new legislation) they have promised to pick this up with the solics but have not got back as yet and I did sign the terms of reference with the incorrect overcharge on.0
