Claim PPI for car finance

Advice please.
In 2003 I took out car finance & was told that the finance company would not accept me for finance unless I took out PPI, I informed the salesman that I had a long standing back injury that prevented me from going to work for sometimes a few months at a time & I would have to claim statutory sick pay.

The car salesman told me that,even with a previous medical condition ,I would be covered & could claim on the PPI,plus re asserted that unless I took out the PPI,I could not have the car,so I took it out.

After about 6 months,my back gave in,so remembering the salesmans words, I made a claim on the PPI only to be told that as it was a previous medical condition,I could not claim, I made a complaint to Black Horse and was told that they would not cover me.

Now with all of the claims in place, can I claim? the problems being that; I can remember the make,model of the car & it was an "R" reg, I remember where I bought the car,I no longer have ANY of the paperwork for the finance or PPI, under the old finance agreements, I terminated the finance after the required amount was repaid, because I felt that I was misled into buying the PPI & that it was missold to me, terminating the finance was the only way to get out of the mis-sold PPI.

Any help and/or advice would be really appreciated.

    Nothing to do with Black Horse if they didn't sell you the policy.
    In this case it appears to be the car salesman, who is unlikely to have been regulated at the time.
    The policy may have covered you for illness unrelated to your back injury.

    The PPI was a condition set by Black Horse, the salesman telephoned them,at my request,and stated that I did not want to take out any PPI,the reply was final, I MUST have the PPI or I will not be allowed to have the car. the salesman was only relaying to me the Black Horse conditions for finance.

    It was made very clear that unless I brought PPI from Black Horse then the finance would not be allowed.

    Your complaint is against the seller of the policy which was the car salesman, not Blackhorse.

    As this is pre 2005, your complaint reasons (which are very weak anyway) are irrelevant as it is pre-regulation and the complaint can be rejected on that basis alone.

    In addition you have no details of the finance….

    I think you need to consider the possibility that the salesman in question wasn't being strictly accurate when "relaying" to you the "Black Horse conditions for finance". It is distinctly possible that the whole thing was a merely a pantomime, and that he wasn't even speaking to anyone from Black Horse at the time.

    Anyway; the complaint would be against the dealership who sold the PPI, pre 2005 sale, therefore not regulated, and no resort to FOS.

    It is unlikely, though not impossible that FOS would be able to consider your complaint and a complaint of negligence through the courts would almost certainly be out of time.

    You might be able to make a claim for misrepresentation but only if you could prove it.
