Can you be made Bankrupt by your creditors?

I have just had a letter delivered to me by hand from a solicitors regarding debts I owe to a mail order company and my currant Bank. Total is £3,102. They are saying the creditor can and may get a bankruptcy order against me? One of the mail order companies i have been in dispute with for over 5 years just have not got any where to resolve this. They say I had white goods delivered to my address. This is not true and i asked for the proof of my signature they claim they left the washing machine on my door step. and the driver after 3 yrs remembers my address and remembers leaving it?? yeah right! any way I owe a my property and the last thing I want is to lose it as i have approx 90k equity. Can they do this? over 3k owed. I am in panic mode now please help me someone! more worry!

    by the way i am paying 4.9% mortgage rate at present i have for the last 8 years. Barclays say I cannot doing any thing about it nor can I extent my mortgage term just so i can reduce my payments each month, it will resolve alot of my debt issues. Basically they dont want to know. I have 14 years to go and my Mortgage is 53k and my property is worth approx 150k. I am 45 years old by the way. This is such a crazy situation that Barclays told me nothing they can do to change anything to help me. Oh they did suggest if I cut down on gas and Electric and food I could afford the payments easy. WHAT A DAMM CHEEK?! unbelievable. 4.9% whats the going rate.....2. something. I could possible half my mortgage payments each month! so frustrating!!

    Yes, they can apply via a statutory demand if you owe more than £750

    Statutory Demands

    In your case you would apply for set aside as you claim you do not owe this, and it should generate a hearing.

    It's likely to be an empty threat.

    Why has it been 5 years and still not resolved...maybe get trading standards or Watchdog involved.

    You have a LTV of 35%, am sure a broker can remortgage you at a better rate than 4.9%.

    Hi there

    I agree with Foxy - 5 years is an incredibly long time for a matter like this to drag on without resolution. I might expect the creditor to have sued you by now if they thought they had a strong case against you - they haven't, so make of that what you will. It sounds rather sketchy at their end to say the least...

    Did the letter refer to other possible action against you? It sounds like it may be one of these generic letters that is sometimes sent out. It's unusual for these leters to be hand-delivered though, so please do check the wording to ensure it's not actually a statutory demand, as referred to by fatbelly above.
