APCOA Admit They Penalise People

APCOA has gone on record and said that they penalise people with their invoices, the driver in pranksters blog stopped for the sum total of 9 seconds. This is what an APCOA spokesman said to the press.
http://parking-prankster.blogspot.co.uk/2014/03/apcoa-admit-luton-airport-fines-are.htmlDrivers should only expect to be penalised if they are seen to use the restricted ‘no stopping at all times’ zones as pick-up or drop-off points.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

So they have just admitted that every parking charge they issue for breaching a 'no stopping at all times' zone is a penalty, and therefore unenforceable. Someone should really take this guys foot out of his mouth.0

This can be used as actual evidence if they go to court, it is a published in the public domain statement from a company representative that is seen as factually correct as it has not been challenged.
Someone save the article and if anyone can get a hard printed copy, even better.
What a gift for the defence.Be happy...;)0 -
...and swap for the other. This a PPC who would, presumably, rank itself in the top ten (at least) of UK PPC's, given its international profile, with the best of legal advice at its elbow, who failed utterly to be able to decipher POFA, understand what "relevant land" was and repeatedly attempted to make use of it at its locations covered by byelaws. So they have just admitted that every parking charge they issue for breaching a 'no stopping at all times' zone is a penalty, and therefore unenforceable. Oh, nearly forgot, and like the vast majority of PPC's seem unable to get to grips with the concept of "genuine pre-estimate of loss" and apply it appropriately. My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
The whole PPC 'industry' or 'profession' is based on a perversion of contract law. Penalties for overstaying in a free car park or stopping in a 'no stopping' area are particularly egregious examples of that perversion....and swap for the other.
