dla to pip

Options
Please could some make me understand....

im so confused.

If someone DLA HRM AND HRC is due to expire in April 2015 (another year away) when would they have to apply for pip instead?

the area of the country they live in is swapping to pip so it will be a case of having to switch to pip.

Do they have to apply themselves or will a pip form come out to them automatically and what happens if they apply for pip and whilst waiting for a decision the dla comes to an end. does dla continue til pip is awarded?

so many worries.

thanks

If renewals are for PIP in your area, then you will at some point (perhaps before your DLA end date, though that is unlikely the way things are going) be sent a 'If you want to continue getting benefit, you need to apply for PIP' pack.

You will at that point have some time to complete and return the form.
If you complete and return the form on time, then your DLA will continue until a decision is made about if you are entitled to PIP.

There is no 'transitional protection' - if you are found not entitled to PIP, then when that decision is made, your money will stop.
You can in principle then appeal the decision, but you will not be paid unless and until your appeal succeeds.
(Or you make a fresh claim for PIP which succeeds).

You cannot opt to stay on DLA, and if you do not complete the PIP form, then your DLA will stop.

    Thanks Roger

So if dla or pip send a form for example in November 2014 to claim for pip as the dla ends in April 2015 then if they didn't make a decision by April 2015 and the dla would end in theory , would they carry on getting dla after April until pip decision is made? Sorry if I'm being dense.

    Thank you

    Yes.

My understanding is the form will typically have at most 4 weeks to complete though.
But even if they take 6 months to complete it and your DLA award would have expired - you continue getting DLA at the old rate until the decision is made.
It's only once the decision is made that you switch - you do not have to pay any back, even if you are found not to be entitled at all.

In theory, you can be called for assessment at any time. But unlike someone who has a renewal date of December 2014, there's nothing set in stone as to what date you will be called in for assessment.
