I have a very strange situation that I would welcome some advise on.
Recently my ex tenants left my property with considerable material change all of which was noted from the check in and check out inventories. However the final check out report was not fully conclusive as it had material change evident in photos but not commented upon in the script and as a result I approached the check out clerk to adjust. Since providing the proof report and subsequently agreeing to amend according to my observations he has since refused to amend the report, and has stated has he has not invoiced me I cannot use to defend my position in court. The damages caused are considerable, so this will need to be addressed via court but he is stating as the report is his property i.e. he has not invoiced me yet this is not my to use.
I would appreciate any advise or help, as I believe he is working for or with my ex-tenants, i,e, they have paid him off to agree to not support the proof report he produced.
I have approached governing who regulate his services but wondered where I stood legally. Damages against him or continue to court and use report anyway against ex tenants? or both.

How long ago did the tenancy end? Do your own check out report (supported by photos) to show the damage/changes for which you wish to claim.0

I do NOT dispute the damages are considerable.
Please please please do NOT throw good money after bad. Done is done. I personally would fix and move on. Courts is an ugly dirt slippery slope.

This case is now with 'nfopp', as the check our agent (1) failed to complete the check out report accurately (2) failed to return phone calls (3) failed to provide his own terms of business according to rules set down by nfopp (4) failed to provide and or follow any internal complaints process (5) failed to provide any business insurance details (6) openly accused me of 'xyz' copying in all off his own staff (libellous) (7) lied to nfopp concerning various details concerning attendance to the check out process an content therein.
I am now hoping nfopp will do the right thing and that this will go to a
tribunal as I would like this company fined and removed from any professional body accreditation and will pursue next with the ombudsman if nfopp fail to follow this through properly, although I have every confidence they will.0
