Anglian home improvements problem

We signed for a new conservatory in November last year for £28,000.00 and paid a £500 deposit, after Christmas, things got a bit tight as I own a small business and lost a major contract, so we decided to cancel the conservatory, I wrote to them and they replied saying that I should have read clause 9b and now I owe them £8,460.00 for loss of their predicted profits, I wrote to them saying that when the sales rep came he never mentioned clause 9b, he said that if the planning permission was denied we would get our £500 deposit back, if we canceled than we would loose our deposit, at no time was clause 9b discussed, although the rep did tell us that his marriage had broke up, his son was in trouble and that when he went home to his leaky house, his girlfriend was going to leave him, at no time did he mention clause 9b, as this clause was so important why wasn't it mentioned, but because I never saw the clause and cancelled outside the 7 day cooling off period that I owe them money, the fact that the planning application never went in until mid January and now my neighbour of 13 years has fallen out with me because he doesn't want it, they are now taking me to court.....any advice...apart from, you should have read the small print....

All they can claim are provable losses. This may include for works already started (in manufacturing units etc.) but such works would then belong to you.
As far as I am aware they cannot bill you for loss of profit.
PS - it must have been a HUGE conservatory to cost £28k! The rule of thumb around here for single story extensions/conservatories is £1k per square metre. (So a 4m x 3m extension would be about £12k. £28k suggests something 7m x 4m).0 -

Loss of profit isn't really a provable loss for a business to consumer contract. If it was a business to business arrangement then they could well have a strong case, but its not and consumers have more protection than business.
