I don't want my insurance company paying out

My son pulled out of a junction on a non public road and a cyclist swerved to avoid him and he came off. There was no contact. This was about 2 years ago. The cyclist’s lawyersput in a claim against my son's insurance company and after an initial amountof activity it went quiet for 18 months. The insurance company has now contacted my son to say that they will payout on this as courts are more likely to side with cyclists.

My son has a number of issues with the claim and its validity and does not want the insurance company to pay out as it will affect his no claims. Can he prevent them from doing this?

    Legally no they are free to handle the claim as they see fit.

    Ultimately speak to them and discuss it. Occasionally insurers will agree to let you defend a claim which they think is indefencable along as you agree to (1) pay your own legal costs and (2) cover the increase cost of the claim caused by the fact its been litigated if you lose
