Yep that is nice and concise with all the main points. There are a few examples of 'windscreen ticket/permit' cases now linked in the 'How to win at POPLA' link in post #3 of the NEWBIES thread if you wanted to look at a few more examples.

Submit your POPLA appeal online, tick 3 out of 4 boxes (not 'stolen car').
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Tale of woe to tell now:

After getting your thoughts on this appeal, I tried to submit via the POPLA website only for the code to be rejected!

I spoke to a POPLA operator and they advised I send a paper copy to POPLA, and that the code was correct. I did this.

I came home from work about three weeks later to find a debt recovery letter, so I called POPLA to ask about my case, explaining how the code was not accepted and I therefore sent a paper copy. She tells me operators cannot confirm if codes are correct, that if the code is not accepted then it is not valid, and also that my paper appeal must have been lost in the post. The operator is not very helpful when I tell her this means I am now outside the window to appeal!

I started to write up a complaint to POPLA and wanted to reference the error message on the site when I enter my invalid code - when I put the code in to test this, it is accepted! So I lodged my appeal online but have just had a letter back from POPLA saying the appeal was received late and I've had the appeal "not registered". This is very bad news.

I don't know what to do now and am not sure this situation is covered in the newbie stickies.

I'm thinking complaint to POPLA about the code not registering initially, and about not being able to confirm codes via an operator, then requesting that my appeal is heard. What does anyone think?

You need to complain to Steve Clark at the BPA , email address in post 6 of newbie stickies.

Did you get a free proof of posting?

  • No I did not get a proof of posting. I sent it at a weekend :s

I'm not sure why I should be complaining to BPA at this point? Isn't it a fault of POPLAs?
  • So I complained to POPLA about my legitimate verification code not being accepted on the website until ten days into the appeal window, and the Lead Adjudicator has rejected my appeal for reconsideration without even acknowledging the website/code problem.

Guess I'll just ignore everything from now on.

If anyone is interested, I genuinely did attempt to submit this via the POPLA website only to have it rejected. I think this could be a concern for others wanting to appeal, as it meant I submitted a paper appeal that then got lost. Proof of postage being the lesson for me :/

Thanks for you help anyway. I'll let you know if anyone tries to take me to court.

I am so often looking at those links these days. It really helps to know who is litigious and who is not.

Lots of debt letters to come, but ultimately no action! Have no fears.

However I do agree that we seem to be having a spate of POPLA issue codes at the moment, so perhaps we should be reminding everyone to check their code as soon as they get it.

A bit like financial investments - current performance is no guarantee of future performance - in the context of court.

But I do think punters are confusing the Small Claims Court, where a relatively 'business-like' discussion is facilitated by a Judge, with the Crown Court where adversarial lawyers battle it all out on behalf of their respective clients, and where criminal conviction is a potential outcome.

No one is going to be sentenced to death in the Small Claims Court!
