Hi,
Last October I had a car repaired and had a courtesy car which I received a parking fine for after having a sleep in a service station. I was in formed about the ticket I received by the garage who passed on my details to CP Plus ltd. I have ignored the letters so far as I am under the impression (after looking at the citizens advice bureau) that it is the garage who should pay for the ticket then invoice me, but now have read that you shouldn't just ignore the letters. I have now had letters from debt recovery plus and advantis informing me of 'debt collection'. I have had no further contact from the garage informing me of the parking fine or that they have paid it, I would like to know how this would stand in court should it (however unlikely that is) to go that far. Is there a way of nipping this in the butt?

They have done the right thing by naming you and discharging their liabity. Now it's your problem not theirs! I suggest you read the sticky thread by coupon mad on your steps now. Basically you have two steps is either ignore or pay. Plus to make complaints to the services involvedWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Are the garage still receiving letters about this? Or are you receiving the letters?
PS - you may get arrested for "nipping things in the butt".

I believe it is just me receiving the letters as I have had nothing from the garage to pay anything or informing me of any further correspondence.
The letter from advantis was to my parents address as they had 'been instructed by the DVLA to the whereabouts. Of me' former resident of ...,,,,,,,,' about 'an outstanding business matter'. Surely the DVLA have my current address as that's where my car and licence are registered , so are they just fishing for info? But that seems weird as all the other correspondence comes to me.0 -

You have already been advised on this, but I will do it again for you, here are your choices.
1) Ignore them
2) Pay them
CP Plus are toothless and don't do court, they are full of the threats but don't do small claims. We can't predict the future though, they will have 6 years to do this.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

If you were happy for the garage to pay it and then invoice you (most of us would be very annoyed at that) then why not just pay it?
If like most people you think the charge is unjust then defend it. You are probably too late to appeal to CP Plus, POPLA when they reject the appeal, but you can always try it on. Otherwise just wait for an LBA and respond to that.
it might also be worth complaining to the landowner to try and get them to cancel it.
Whining to a court that the garage should have paid it is a non-runner as they have discharged their liability legally.0 -

Absolutely - you never had a PCN so if they ever tried court they'd struggle! But they won't so ignore it, don't pay it!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
