Ebay fees and Intrum Justicia

Options
Hi

I've been getting calls from Intrum Justicia about £85 of ebay fees that I owe. Looks like the debt has been transferred to them to recover. My ebay account has been locked and while I do owe the fees I am reluctant to pay because paypal had just frozen my account with £150 while it "investigated" where the funds came from. I have heard that this can take an age and I might never get my money.

So my questions are:

1 - Do Intrum Justicia have any real muscle or are they all mouth and threats?
2 - If I get a solicitors letter is it likely to be from them ie. not a 'real' solicitor?
3 - Can Intrum Justicia take the matter to court to obtain payment or will they just give up after a while?
4 - Am I likely to receive a "visit". Does the visitor have any power?
5 - Should I ignore Intrum Justicia (say the person they are ringing for has moved out and return to sender any correspondance) or should I pay up?
6 - If I don't pay is it possible I could receive a CCJ or my credit rating could take a caning?

many thanks for any assistance offered

IJ may go for a CCJ against you, yes, which would bump up your debt by a fair amount.

IJ are a Debt Collection Agency so their 'solicitor' is likely to be a member of their own office.

Having said that, they would have to go to Court and prove you owe the money whereupon you could challenge it with the fact that paypal, whom are owned by Ebay have money held over and above what you owe.

It is best to keep channels of communication open with IJ to let them know what is going on.

Also you need to phone paypal, since they are only holding onto the money because of Ebay.

Not sure how far IJ would actually visit you or merely threaten it to try to make you pay up. If you have a look at the Debt Free Wannabee Section there will be details on IJ and other folks' experiences of them.

1 - They have as much power as any solicitor.
    2 - A solicitor's letter is a solicitor's letter, if not from a real solicitor, it's not a solicitor's letter
3 - Yes, whether they will is debatable, especially for £85
4 - Possibly. No visitor has any power if no court action has been taken
5 - No, no need to lie. State your case, paying up is your decision.
6 - Yes if they take you to court and you don't pay. You can put your case in court if it goes that far.

It does cost money to issue a claim against you, so they would try and work out if its worth going to court or write off the debt.

What was the original problem? Have you contacted Paypal to ask them to pay the fees?

    Hi BritishDragon

Please do not worry about these people....they have absolutely no clout whatsoever, and are in fact just a debt collection agency that Ebay and Paypal employ to try to frighten people into paying fees etc.
I had a Paypal dispute opened over an item that the buyer says arrived broken, but they did not provide proof that they sent the item back..which they didn't.
Paypal came down on their side (as they always do) and my Paypal account went into a minus figure situation, as the buyer got their money back. Thankfully... I always cleared my Paypal account when it got to more than £50.00, so there were no funds in it.
Intrim Justitia kept calling me at home, but I sent them a very stroppy letter, and they replied saying that they were going to pass the letter back to Paypal and I would not hear from them again.
That was nearly two months ago....and absolutely nothing has come of it and I haven't heard from them since.
As you have not signed any agreement between Ebay/ Paypal and yoursellf.....Intrim Justitia cannot legally do a thing to claim money back from you. They are just bullies.
If you PM me your email address, I would be happy to send you a copy of the letter that I sent to them.
When life throws you lemons...put them in a gin and tonic !!

As a Seller/Buyer you have a legal commitment to pay any fees owing to them.
In signing up for the service you commit to their terms & conditions whether you like it or not.

IJ can and do have clout - read the DFW thread - they have the power to take anyone to Court - as does anyone else - to obtain a CCJ.

IJ also work for some of the high street banks, etc, they are not tuppence halfpenny as a DCA.

It is very naive to suggest that IJ will back off - they do not. It could be that IJ are not finished with you yet.

    What is the DFW thread?
I am just talking from personal experience.....are you?? Have you had any dealings with this company, or not?
I can only tell it like it is, from my experience and have the letter that they sent telling me that they are not going to be dealing with this any longer.

... I defaulted (in my dark distant past) on poll tax when it was poll tax, and Intrum Justicia were the folks who were set on me. If you try to help and find a way to pay it off they are likely to take a favourable attitude with you (as I found out later after burying head in the sand syndrome)..... but they won't go away, their fees will spiral and the last thing anyone needs is fees on fees.

I'd be on the phone to them now to make a payment arrangement if I were you OP because unless they have changed then they won't be going away.

... with respect, better bargains, yours is a debatable point which is based on doubts over a delivery. Fees are undeniable, and much more easy to follow up.
