PayPal 'chargeback' from buyers credit card.. 2 months later

Hi all,

I'm hoping somebody may be able to offer some advice on the situation that I’m in.

Before Christmas, I sold a body shop gift set (as I had 2 of them) on eBay for a decent price. Sent to seller, no feedback left but no messages saying they hadn’t received or had problems with it either. Foolishly I didn’t send the parcel tracked so have no proof of postage.

Fast forward 61 days later and I receive an email from PayPal advising that £26 odd (price of item) had been taken from my balance and also a £15 fee for this happening (leaving me in negative) as the buyers credit card company was disputing the charge due to 'unauthorised use'. I sent the buyer a message and haven’t received a response. I also emailed PayPal to express my disappointment and they came back with the usual 'appreciate your frustration but nothing we can do....' and then got a further email a few days ago stating that the case had been approved in the buyers favour so I won’t be refunded the charge that had been taken. I've now sold some items on eBay and that has cleared the negative balance. Therefore, I’m out of pocket because the buyer has put a claim in and it has been approved. He hadn’t contacted me at all in the meantime and I can also see he has been active on eBay due to his feedback but he hasn’t responded to my multiple messages.

Is there anything I can do - I'm assuming not as I don’t have proof of postage but thought I'd ask anyway. Lesson learnt for future if not!

    Get proof of postage. If you're sending £26 worth of stuff through the post without one, that's just lunacy.

    It is probably too late now but for future reference you can defend a claim for unauthorised use of a card by providing proof of postage, you don't need tracking or proof delivery.

    We always recommend keeping your POPs for a minimum of 6 months because of this, so if you have it you could try seeing if PayPal would allow a late appeal.

    Yes - issue a 'Final Notice Before Action' letter to the same address you sent the goods. Send it Registered Post. Ask for the 26 pounds stolen + the 15 charge to be paid to you within 14 days. Also tell them if they do not pay this, an additonal 25 will be added to cover a claim to MoneyClaim if they don't reply.

    If you don't get any joy, issue do issue claim via MoneyClaim (aka Small Claims Court)

    Assuming the buyer's address is real, and the credit card used is registered to that address, you will win the case, should the buyer be foolish enough to try to defend it. But it's very unlikely they will, it's is very unlikely the credit card charge was in fact unathorised.

    Chances are you'll get your money back from the buyer, and probably some excuse about the chargeback being a mistake.. but I'd say you've got a 85% chance of getting paid back by the buyer for the cost of a Registered Post letter.

    Try it, and please report back. I think you'll be 41 pounds better on this time next week.

    This is nothing to do with Royal Mail.

    The seller is being subjected to an 'unathorisised payment' charge back.

    Why not? Maybe the buyer didn't receive the item so did a chargeback? Maybe the item was lost and they didn't understand how to get their money back. So why not claim with royal mail, theres nothing to suggest the item was received by the buyer. No feeback was left, etc.

    The OP will get nowhere with PayPal without proof of delivery and so will be out of pocket. I would claim with Royal Mail.

    Edit: Ignore me, I've not read this properly. So the buyer isn't claiming item not received, they are claiming their card was used by someone else? I get it now.

    Online proof of delivery is only needed to fight an item not received claim.
    If the claim is a chargeback due to the unauthorised use of a payment card then all you need to provide is proof that you sent the goods to the buyer.

    Have a read of the postage sticky.

    But to clarify your thought.

    To win an INR dispute - you need to show online tracking, a signature is not required (on Ebay) for items under £750.

    To win a Paypal CHARGEBACK, then proof of posting is all that is needed, which is free from the PO and should be kept for 180 days at least.
