No LBCCC but debt letter, advice please?

    So your options are as per bod1467's post #9 above
    or
    your husband submits a late appeal to the Ntk as the keeper to try to get a POPLA code but as bod says they don't have to, however, equally there's nothing to stop them accepting a late appeal - but it may take a number of letters and there's no guarantee you'll get it. It has worked in a number of cases though.

    Whilst he can still name you as the driver, and so discharge his keeper liability, YOU (as driver) have missed your opportunity to appeal.
    Not if some prankster (no relation) had removed the NTD or the Parking Operative had removed it after taking a photo 'to avoid confrontation'. The PPC can never prove that the NTD was delivered to the driver so the option to appeal is always open.

    It's only UKPC - I would not be telling them who was driving nor giving them any information, if your husband has left it too late to appeal as keeper. He should have appealed as the keeper, when he got the NTK in the post. If that was dated more than 28 days ago then it's too late (technically) for him to appeal.

    As this was a windscreen ticket there's no point naming the driver unless your OH can't cope with some junk mail like we have always ignored ourselves on this forum for MANY years before POPLA even existed. It's no biggie. It's debt collector letters, that's all, no effect on credit rating so don't go panicking about CCJs and irrelevant worries.

    Hi,
    Sorry for the late reply and thank you for the responses.
    Yes we are in England, northwest.
    Sorry for the daft question but do we just ignore it then as it was a windscreen ticket? Or do we appeal and hope to get somewhere with it?
    It was my fault for not appealing it, my husband is blind and our daughter now requires a lot of care unfortunately. I've just not had the time to sort it out but I do now we have help via carers coming to the house. I also can't afford the £160 wanted by the debt collectors.
  • I am sorry to hear of your family's problems health wise.

    You do have a couple of alterntive options:

    1 Make a formal complaint to the landowner/retailer to get this parking charge cancelled. this is a definite option to do and point out that not only was the driver on the day(no need to name) but that the normal appeals process was overlooked due to family members (who are covered by the Equality Act) were in need of urgent medical attention. Also point out that the stress of receiving debt collector letters is having a detrimental effect on the family.

    Make a late appeal to UKPC - disputing the debt and point out that members of your household are covered by the Equality Act.

    You can either continue to ignore the debt recovery letters or respond robustly denying the debt and referring the matter back to UKPC.

    Should you happen to receive a solicitors letter purporting to act on behalf of UKPC then come back.

    UKPC have not done court todate - unless they are taken there themselves.
