PPI Claim Refusal - Barclays

Hi
I put a claim in to Barclays rgearding PPI insurance that I found out that I had years ago on a credit card.
I know that I had never requested it, as I have never taken out any other PPI on a credit card or loan.
I Filled out and sent off the relevant forms to Barclays stating the reason i was mis-sold was that it must have been added without my knowledge.
They wrote back and stated they felt I had no claim, as at the time the credit card was taken out, I was employed so in afffect I needed the insurance.
Now I thought it was up to barclays to prove that they weren't in the wrong, not me?
Are they just trying it on?
I am going to contact the financial ombudmsan, and if so, is there anything I shoudl say in particualr when I write, as I fear as though I am the one sounding im in the wrong?
Any help appreciated.

No. The law is that he who asserts must prove. So if you're the one accusing someone of wrongdoing you need to show in the balance of probabilities that you are in the right.
How long did you have the insurance for? It would have been on every statement you received. Did you not question it then? These are all questions you are likely to be asked.0 -
You are in the wrong really. As Insider101 says, you would have seen it on every statement you received. It looks a bit suspect to now claim you were missold it and never wanted it.0

pretty much the weakest of all the complaint reasons you can give. You would rarely expect that reason to succeed. The complaint response seems correct (due to lack of evidence). They have then done the right thing in checking to see if you were eligible and are saying you are.Now I thought it was up to barclays to prove that they weren't in the wrong, not me?

No. The available evidence, whether supplied by you or their own files, has to point to a balance of probability that it was mis-sold. I always paid by card off in full, and never checked my statements, bit naive really.
Not desperate to receive a lump of money just wanted to know if I had a case.
I guess from what everyone is saying here is that I shouldn't have admitted to Barclays that I had seen it on a statement, and that I should have guessed that I had PPi insurance that I never asked for?0 -

In which case, you would not normally have paid a penny in PPI.
