Landlord Selling Home. Need some advice.

    ah good (kind of)! this gives you a lot more leeway.

    the prescribed info is the details of the deposit protection, that your LL must provide you with after you move in and pay a deposit.

    your LL has broken the law by not protecting the deposit and hence, not supplying you with this info within 30 (?) days.

    Before you move, leave enough time to request the deposit back in WRITING, reminding her that she has acted unlawfully by not protecting it, and request it back in FULL. If she refuses don't pay the last rent, to the value of the deposit.

    Thank you for the advice guys and girls. I am going to call the letting agent today and instruct them to only arrange viewings on a Saturday between 12am and 3pm. I think this is reasonable.

    The only reason I do what the landlord asks is because we rely on her reference to get another property I don't want a bad reference. But it is unreasonable now, and really doing my head in.

    Paperwork that you should have received as your deposit should have been protecetd by the Landlady within 30 days of her receiving it. There are legal penalties for not doing so.

    Looks like you have an amateur LL here, get your ducks in a row ready for your onward move, you may be able to get more out of this than you think.

    Well then you can do any of the options suggested above without risk of being given a valid S21 Notice!
    Choices are:

    1. Refuse to allow viewings at all but LL may issue a Section 21 notice for possession.
    2. Agree to viewings on certain days/times at your convenience.
    3. Allow all viewings and negotiate a reduction of rent for your convenience.

    No, and no.

    Again, WRITE (pen, paper, stamp), to the LANDLADY and inform her of this.

    Of course, feel free to copy in the agency, but address the Landlady, not them.

    Excellent advice should I need to go down the "playing hard to get route". I'd much rather do this amicably, and work with her, but if she wants to demand and dictate I now know I have rights.

    I'd be changing the locks so not one can get in. (change them back on leaving)

    I also think you are under no obligation what so ever to have viewings, as you have a right to quite enjoyment of your house.

    I would put everything in future in writing, and make sure you get it back in writing.

    Good :) general advice is to send 2 copies from different Post Offices (NOT recorded as it may be returned if there is no one to sign for it), and retain proof of postage for both.

    Thanks, will do that.

    I am also going to keep a log of viewings, with photos of the property at the time of the viewings. If I have to play hard to get and she gives me a poor reference, at least I know I have all the proofs that we were good tenants that paid on time and kept the house in good condition.

    I've even decorated one room, which is a + for her in terms of viewings because previously it was awful. It's now fresh and clean. Might I add this room cost me over £400 to decorate because I wasn't told the walls were cracked, and falling apart. I feel sorry for any buyer that is under the impression the walls are fine.

    Sometimes it feels like it's my house and I'm the one selling it with the amount of effort we put into making it perfect for viewings lmao. I really should request a reduction in rent but I know for sure that isn't going to happen so I won't even ask.

    I'm just not going to spend as much time and effort for viewings no more.
