Debenhams Gold Card - Santander

My wife has recently submitted a PPI claim with Santander re a Debenhams Gold Store Card, that she has had for many years. The card was 'sold' in store by a sales assistant. The amount that she has paid over the years is high, as for many years the card had high balances upon it, with minimum payment set up as a direct debit.
She simply did not need the ppi as she has full sick pay in her employent for 6 months and there were no discussions at all in store about the ppi. She absolutely accepts that the ppi is shown each month on the statement.
This appears to link bank to the fine issued to GE Capital in 2007 which makes a number of points which tie in exactly with how this policy was 'sold' to my wife.
I have read differing stories as to peoples experiences with Santander but surely their position is weak following the FSA fine?

    It isn't because Santander have no responsibility for the sale of the card to your wife, as Debenhams store cards weren't regulated at the time of sale.
    She has to complain to Sanatander, who will refuse her complaint, then she has to find out who the insurer was and complain to them, but that is not a guarantee of any money back.

  • Letter received refusing claim , not as pre 2005, card was taken out in 1993, but on the basis ' ppi was on a non advised basis, with sufficient informed choice at point of sale or soon afterwards to allow you to make an informed choice whether to add ppi to the account. No advice was provided or recommendations made as to the suitability or otherwise of the insurance . I can confirm on the agreement signed it required you to tick a box if you did not require the insurance , which you did not tick....
    It says complain to FLA .
    Surely that isn't enough.. No enquiries re wife's employment and the pay she would have received for 12 months , no explanation at all as to policy or suitability ,
    Should she just now complain to the insurers direct , seems complaint to ombudsmen is ruled out as pre 2005.
    Any thoughts?

    The insurers (if they still exist) will put your enquiry on the 'ignore' pile knowing they have no liability to you.

    Not exactly helpful... But thanks anyway for your well thought out comments..
    The insurers of course exist they are Genworth , anyone got anything productive?

    This is a pre-regulation (by some considerable years) complaint for which you have no access to the Ombudsman. You can indeed complain to Genworth, but they don't have to even consider the complaint.
    The fact that Santander didn't mention that it was pre-regulation in their letter of refusal is irrelevant, I'm afraid.
