I have sent the letter suggested to UKCPM however since then I have received an interesting letter from the Debt company!

Eventhough they never saw the letter I sent to UKCPM or had a letter from me apart from to say I wil not discuss this further, they have sent me a letter which basically responds perfectly to the standard rejection letter! I am not planning on contacting them further as I have written to UKCPM and they did not say to talk to the debt people but I wanted to get some advice on their letter.

Are they correct in what they say back? I know it is never too late for a POPLA code, which I put in letter to UKCPM but what about their other points?
Would rather not end up in court over all this haha!
    Advice gratefully received!

CPM have sent the letter on to the debt collectors so that is your reply to your appeal. If they have cited keeper liability I would complain to the BPA since there was never a NTK served. Therefore NO keeper liability and you have already told them that the only letter you got was a debt collection one.

Do not refer to the PCN, do not talk about the day nor who was driving.

Search this parking forum for 'my findings' as your keywords. Go on..!

Who the f*ck do they think the BPA is - 'the sum is what this body deems reasonable'? Paid by, and acting on behalf of no one other than, the PPCs.

    On the GPEOL front:

'Loss of potential parking fee (where one is payable)' - covering all bases there DRP - so this can't be 'genuine'! How much then (where one is payable)?

'Loss of revenue (if this is a retail outlet)'. Well, DRP, is it or isn't it? And now the really tricky one for you - how much? And if you collect on this PCN to whom will this 'Loss of revenue' be paid? Because the least entitled to this would be you (or the PPC for that matter). And if it isn't a retailer, then there's no 'Loss of revenue', so how come the PCN charge-level is the same? A very Disingenuous Pre-Estimate of Loss - DPEOL. :rotfl:

Thanks for your responses guys :-)

I have already responded to UKCPM requesting POPLA code again etc so I am not going to bother replying to DRP as it would only be the same letter that I have sent to UKCPM, and not worth wasting my money on more postage!

What is the likelihood of me getting a POPLA code and are UKCPM known for taking these to court? Just so I know what I am getting myself in for!

Here's an 18-month look back at which PPCs have been trying their luck at court.

Don't see yours there. Whilst this is an indicator, it's not a guarantee for the future.

You are unlikely to get a POPLA code but should complain to the BPA who may persuade the PPC to cancel it, since there was never a NTK served. A complaint to the BPA is one simple email to the address in the NEWBIES thread post #6. I would do that, obviously NOT talking about the PCN/the parking/the driver!
