Pay for the consultant. If you're wanting to use the emails as evidence in a disciplinary it'll help to have a proper audit trail and expert witness statement. For criminal proceedings this would be absolutely required.0

Take a copy of their mailbox now, the first sniff that they think you are onto them then all the emails will go. Seen this many times. I manage a network of 750 users and been tasked for similar a few times.

We actually run an archive system (in our case a product called Mimecast) for legal reasons (like this in your case) so even if a user deletes the email we will have a copy.0 -

You can probably add 'in the ensuing unfair dismissal employment tribunal' to the above list too. Paying the professional in this case is probably likely to keep you well covered from future risks and costs in the long run.0 -
You could change permissions on the users mailbox to open it as the Exchange Admin?0

Got to agree with the "get a qualified consultant".
Also check and make sure you are taking backups of the SBS server. Also check back to see if you have a backup around the time the initial emails were probably sent.
DON'T Try to access the backups! leave that to the consultant. just make sure you have backups available.
If they are anything like the usual worker! they will never delete emails until the mailbox fills up or they need to hide something! ^_^
So hopefully if they do now delete anything you'll have a copy.
in Exchange it's easy to give access rights to anyone if you are the administrator.
In my last place I was the admin for a SBS setup,
Both of the companies Managing Directors had full read access to every mail account and department heads could only read people under them. A few (Like me!) also had limited read write access to all accounts except the MD's.
But I was working in a small place and we all knew and trusted each other with email access.Laters
