Those Wonderful Lifesaving People

....have got me again for the third time in a year.

Fair enough, i accepted my past two fines, one i was 3 minutes late returning to my car and the second i parked in a poorly signposted street, but this third one i will not accept.

I'm a student in bradford, now parking at university is often difficult if you don't have a permit (which i don't - £150 i don't need to spend), so the streets opposite and around campus get full quickly.

Recently (in the last two weeks) they decided to widen the curb opposite the entrance to university, either to let students cross the road or just to make to road even narrower and risk car accidents, the motive for which i'm not sure. Anyway, today i could not find a space, so i parked it (perhaps a bit cheekily) on the right side of the new construction (the left side had cones and lines, the right side i parked on did not). I've uploaded a poorly drawn diagram to help visualise this a bit better.

I came out to find a lovely sticker on the windscreen of my car, with the reasoning "27 parked in a special enforcement area adjacent to a dropped footway".

Now here's my defence

1) NO cones, lines or signs around on the side i parked
2) Parked there before, never got done
3) I've seen numerous other cars park there on a daily basis

Do i have a case to appeal? Surely there has to be double yellow lines !

Thanks in advance - really do appreciate it. I'd really like to get out of paying this fine, even if it is only £35 in two weeks.

    Hi and welcome to MSE

Your issue appears to relate to a council issued PCN rather than a private one (unless you tell me otherwise). If your ticket was issued by a private company then stick around and tell us which company. However, if yours is a council ticket then I suggest you take yourself off to PePiPoo where there are experts who will guide you. Council tickets are always worthy of appealing - 60% of all appeals are upheld (though not at the first, informal stage).
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • It's a council one, i think i will appeal on the basis that i wasn't actually parked adjacent to the lowered curb ? (see diagram). I was actually adjacent to a raised curb

Then, in the end, you should win - but please, please, run the PCN by pepipoo experts first. Post with BOTH SIDES of the PCN shown in your thread like you will see in the other threads there. You may have more grounds for appeal. As HO87 says, on average 60% of all appeals are upheld (though not at the first, informal stage) and in some areas the % win rate is 80 or 90%.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
