Please help me with my Ipod problems!

I purchased a brand new ipod nano 2nd generation from an ebay seller 3 months ago. A reliable seller with loads of good feedback.
It has now developed a fault, the menu button wont work.
I have contacted apple and they dont recognise the serial number (therefore they wont repair it) so they suggested i took it to my local apple service centre. So, i took it into them and they said they believe it to be genuine ipod but that apple wanted them to send pictures of it and they say they dont have a digital camera (so basically they dont want to help anymore).
I tried calling apple again and was cut off by one of their lovely telephone operators (who sound and act like they are from a different planet) before I even had chance to explain the problem.
I am now pretty annoyed that I have spent over £120 and cant get my ipod repaired under its warranty.
Please help me someone. Im not sure what to do now. Should I insist that the seller rectifies it?

hopefully they wont but the seller can just turn a blind eye, under paypal's terms and conditions you cant file any form of dispute after 45 days from the date of payment.
I would push apple a bit more, if they want pictures then take them yourself?0 -

Contacted the seller who told me to try apple again, that was a few days ago. Have now emailed the seller saying that in my opinion its up to them to resolve as the 'contract' is between them and myself - the listing did actually state that it was a new ipod nano with 12 months warranty.0 -
All new items come a standard 12 month RTB warranty (manufacures)
If you had bought this from a shop, most they would have done is return it to manufacturer to be repaired.Mansion TV. Avoid at all cost's :j0 -

That is what most retailers would do, although not what they should do, OP is correct, contract is with seller. It does seem 'unfortunate' for the seller, but true nonetheless.
If you funded the payment by Paypal with a credit card, the credit card company also provides a guarantee along wih the seller, so that may be worth following up if applicable.
I'd also write to Apple and imply you might be contacting the media, that they or their representatives are not willing to help with their faulty merchandise. Apple have quite a good forum for Ipod problems with lots of good advice, so they may be able to help..0 -

I like the idea of writing to Apple but finding an address for them in the UK is something im finding very difficult! Anyone know of it?0 -

Take it back to the appl shop and when they say they don't have a camera tell them to use the built in one on any of the imac they have and to stop being so dim0
