selling a second hand car. sold at time of deposit?

    Give him his deposit back.

    As others have said, the contract was formed on the basis of you supplying the car in the agreed condition. You cannot, therefore give him his deposit back.

    Imagine if it was the other way round, would you REALLY be happy for the seller to keep the deposit?

    On second thoughts, keep the deposit, don't tell him anything, that way you'll really be out of pocket when it comes to court, he wins and costs get awarded against you!!!!!!

    The OP will not be back. This is one of the most absurd threads I have seen in a long time.

    But not quite as bad as the daughter selling the family cat or holding it to ransom for the reward............... or whatever, in the consumer right board just now!
