ParkingEye County Court Claim Form

Hi All

I have just been forwarded my post having moved house a couple of months ago (its been a nightmare!). To my horror i have found a number of letters, and now a county court claim form for ParkingEye.

Now, reading through the letters, it appears I have had a "notice to keeper" and am being persued under that pretence.

Also, I did park at this time and did over stay the time limit (by approximately 20 minutes)

I have had a read of the forum but am still a little confused as to what to do in my circumstance so ill try include some facts that i think are relevent.

- The car park is a mini retail park and managed by ParkingEye
- I was caught by the number plate recognition camera entering and leaving.

Now, the bit i really dont understand, and time is certainly an issue here, is am i too far down the line now to have any type of defence?

Without giving away any specifics, i only have a couple of days left until the 14 day period after the issue date.

I have read a thread started by zzzLazyDaisy (cant link as newbie) that potentially i could "reset the clocks" by claiming someone else was the driver and giving their details? Though any letter is not going to get there in time.

Would I have any luck ringing ParkingEye and explaining the delay in getting my post and offering to pay the original fee over the phone?

Am i pretty much screwed now because i have so little time?

Any advice would be greatly appreciated.

    Ive just re-read and understand that i have 14 days from day of service, which is 5 days after issue date, which actually gives me a week give or take...

    If these are actual court papers then the first thing you need to do is acknowledge the claim and say you are going to defend. This then gives you a further 28 days in which to prepare and submit your defence.

    You've read the LBCCC thread but that's not relevant if you have Northampton court papers already. Too late now to name the driver and reset the clock, sorry.

    No do not ring them. Repeat, DO NOT ring them they are suing you and you must follow procedures to defend this. You are NOT screwed and if you just paid up what they are demanding that would be daft seeing as you may as well defend it and/or make an offer of £20 if so minded (or offer nothing and complain to the retailer/landowner - and if not cancelled, then see PE in court once you are well versed in all this). If you read other small claims threads by searching this forum and pepipoo forum you will find LOADS of outcomes from people (lots of threads on pepipoo parking forum about PE court cases and what happened).

    1. Please read the 'Small claims Court' links I put in the NEWBIES read these FAQs first' sticky thread. You need to read the links there under the Small Claims Court heading, to see what happens when and to learn about all the victories by posters so far! There is lots of info there but not too much.

    2. Go ahead and acknowledge the claim online with MCOL saying you will defend in full (BUT NOT sending a defence just yet!). Do NOT 'contest jurisdiction'.

    3. When you have read the NEWBIES sticky thread links and the Prankster Guide, send me a pm over the weekend as I have a template first appeal I can send you. Lots of people use it but the main homework is yours because you will need to be ready for the N180 from (explained in the NEWBIES thread links) and be prepared with your court evidence, fully conversant with the issues to raise. And ready for their bluff and bluster 20 - 30 page reply to your defence, as mentioned in another PE thread today from someone who's further ahead in the process than you.

    4. Complain to the retailer if it's a retail site. And I mean, COMPLAIN to the CEO, immediately by email!
