Hello everybody,

I'd like to know if I'm entitled to Severe Disability Premium. I failed my ESA assessment almost a year ago. My appeal is coming up in a week and I'm expecting to be successful. I get DLA (middle rate care) and high rate mobility. Nobody has ever claimed any kind of Carers Allowance for me. My benefits advisor called me this afternoon but I'm not able to take information in properly at the moment. I asked him a few days ago about getting some SDP backdated and he was quite optimistic about getting backpay to the start of my ESA claim but today he told me that I wasn't entitled to it as my ESA isn't contribution based. I don't understand if he was saying that I'm not entitled to SDP or if he was just saying that I couldn't have any backpay. Can anybody please help me understand?

T get SDP your esa needs to be income related or contribution based with a top up of income related

Sorry, I don't really understand. Sorry so be stupid. What does income related mean to me? I do a part time job under the 'supported permitted work' rules. Does that stand for anything?

Contribution based ESA is based on your NI contributions and is not means tested (ie. does not take into account any other income/capital/savings for you or your partner)

Income based ESA is assessed on your income/capital/savings and also your partner's.

If you are on contribution based ESA and are not eligible for income based because of other income/capital/savings of you and your partner then there are no premiums given.

    QUOTE

If you are on contribution related ESA you will only get an allowance for yourself. If you are on income-related ESA you also may get allowances for your partner, if you have one, as well as additional premiums (pensioner, severe disability, carer and enhanced disability premiums). There is no disability premium with ESA. - See more at: http://www.disabilityrightsuk.org/employment-and-support-allowance-overview#sthash.n09i058m.dpuf

Permitted work earnings do not count towards 'other income'.

So if you think you are entitled to income based ESA because of a low income/savings then post back.
