Response to Roxburghe - Luton APCOA challenge ignored

Thanks for the responses.
Before I respond to the SRA (who are they?) .
That's a red herring - the SRA is the Solicitors Regulation Authority, and is only relevant where you have had dealings with a solicitor and you have a complaint about their professional (mis)conduct.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
But surely, if a solicitor writes to you, you have had dealings with that solicitor. If a PPC invoices you for an amount which they know is unenforceable, then that letter/invoice constitututes fraud.
a solicitor then writes to you about that debt, then, is it not encumbent on them to ascertain before so doing that the debt is not fraudulent.
I know that solicitors enjoy some sort of protection from prosecution, but they must know that nearly all PPC invoices are fraudulent. Should they therefore not ensure that they are not complicit in a lawbreaking. You never know how far you can go until you go too far.0 -

A solicitor is not obliged to act as judge and jury in considering his client's claim. It is not entirely true that PPC'c PCNs are unenforceable since PPCs can point to a significant number of 'wins' in the county court. Admittedly many will be default wins where the defendant has failed to defend/ turn up, and an equally large number will be against unrepresented defendants who turn up but do not understand the legal arguments and/or are unable to present a decent case. Nevertheless, simply acting on behalf of a PPC does not constitute misconduct on its own, although the way in which they choose to handle the case may well be.
But that is irrelevant in OP's case as he has not suggested that he has received any correspondence at all from a solicitor.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Hi,
My friend just picked up my niece from Luton Airport and as he approached the drop off point she ran out from the left and flagged him down, anyway the road was clear so he stopped in the middle of the road (no traffic at all behind him) and she jumped in the car. (no luggage as she arrived on a coach) stopped for about 10 seconds.
As he drove of he see an APCOA camera van sitting up the road so am assuming I will receive a fine for stopping in a no stopping area as I am the registered keeper ??, question is due to the change in the law last year how do I stand on this I know its complicated due to various bylaws when airports and stations are concerned.
Do I pay up and take it on the chin if a ticket arrives or do I Ignore it or challenge them with a cleverly worded letter??
If its the letter option which one should I use???
Any advice would appreciated
Thanks,

You need to start your own thread, not hijack one that someone else has started as all replies will only be to the original poster's predicament.I married my cousin. I had to...I don't have a sister.

Complicated? It's easy! That's why there's template 'fits all' first appeal letter in the top thread, couldn't get much simpler for newbies really.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
