Parking eye query

Evening all,

I just have a couple of questions about a recently received charge notice.
I've seen plenty people writing on this forum about the PCN Having to be received within 14/15 days of the 'offence'
what happens if it's received after that? As in 19 days after the 'offence'?

Secondly I'm just wondering if anybody has tried to say they weren't actually parked up but just picking people up that may have happened to be running a little late?
For example, mine was for 31 minutes at a Morrisons car park which last time I parked there (was a few years since mind) it was free so I just parked up, looked in some car windows.. No tickets seen for pay and display so assumed it was still free...... Until now!
What's the chances of getting off saying I was picking someone up, maybe a disabled passenger that I had to fold a wheelchair up for and pack shopping away etc?

And last but not least, has anybody complained to a supermarket about the charge who actually didn't shop there or they didn't have proof about it? Wondering if the supermarket would ever check their CCTV and check you were actually in or not?

    if POFA 2012 is implied in the PCN then they are "out of time" as you should have received it within 14 days if no windscreen ticket was issued

    so its still a valid invoice but POFA 2012 making the RK liable for the pcn cannot be used , meaning they can chase the driver only (if they knew who it was)

    these issues tend to not be about being "parked up" but "on the premises" but the PPC wont cancel on those grounds and rarely cancel on any mitigation apart from large receipts showing patronage of the shop or retailer

    complaints to the store themselves or to the CEO of the chain can yield cancellations but in the meantime appeal it as per the NEWBIES sticky thread with the PPC , do not leave it or ignore it IF its in england or wales

    It doesn't make the ticket 'illegal' or anything but it DOES mean you can add to the template 'first appeal' letter you use from the NEWBIES sticky thread, a point #4 that the NTK was received too late for keeper liability under POFA2012.

    Nope that's just mitigation, Doesn't win at POPLA so don't bother with that. It also leads people to write in a rush about what happened and then they go and say or imply who was driving. All wrong!

    Possible but unlikely. Why would you try mitigation though, when we have the winning words for POPLA appeals here already in the sticky threads. We win 100% of the time! You don't seem to have read the NEWBIES thread I wrote, near the top of this forum, calling you to 'read these FAQs first'. It has your answers and your templates to use.

    A Supermarket would not check CCTV over this but of course people have complained and got the tickets cancelled that way - some without receipts. There's a whole extra Sticky thread about 'Successful Complaints about PPCs' linked by Crabman at the top of this forum already - which is another thread I wrote, like the NEWBIES sticky thread, the intention being to stop people missing the answer to how to appeal and win.

  • I had read quite a bit and went through everyone's complaints to Morrisons and it seems they all had proof of purchase etc but thanks for the replies, I have got on to Morrisons and they have asked me for all the details so they can investigate it... With a bit of luck they get it cancelled for me, if not I intend to follow every step you have set out in hope of a successful cancelation of the PCN!

    Don't forget to also appeal online to PE anyway. Use the template in the NEWBIES thread and add a point #4 that the NTK arrived too late for POFA 2012 'keeper liability'.
