But if I've already admitted I'm the driver...?

Greetings from a Newbie.

My humble apologies if this has been raised elsewhere, there IS a lot of information on here and I did look through the Newbie Sticky.

I forgot to pay my parking yesterday at a SWT station and realized this morning, quickly paying it by my phone.

When I got back to the car it had been ticketed once for yesterday and once for today (CP Plus).

A friend advised me to not pay up and after a quick search I found a wealth of info, including all the gems on this site.

It does look like a lot of people are managing to get off their fines but before I entertain the thought of putting up a fight I need to mention that before I was advised about this I sent an email to the CP Plus appeals address, pleading for them to apply discretion about today's penalty as I paid as soon as I realized, but that I still intended to pay yesterday's.

Bearing in mind I have identified myself as the driver have I scuppered any chances of getting myself off?

Again, sorry if this has already been answered. There's a lot of information here and I did have a good look through but couldn't find an answer.

    Have they responded to your email?

    Does your email identify YOU (as a person) in any way?

    Are you the registered keeper of the vehicle?

    CP Plus sometimes issue tickets under railway bylaws. Does it mention bylaws on it?

    My email explains that I was hurrying for the train, forgot to pay using my phone app and only remembered a day late (today), at which time I paid immediately. I asked for leniency, offered to pay the one day, but asked if the second day could be considered. I referred to myself by name.

    The notices both mention Section 219, Railway Byelaws section 14, etc.

    They have replied, notifying of receipt of the mail, an auto reply.

    Yes I am the registered keeper of the vehicle.

    Have I stuffed myself?

    The advice here does go heavy handed on sticking with the registered keeper line but you are far from stuffed and lots of people win as driver.

    The basic appeal points that the standard letters win on do not depend on the registered keeper trick, they are just belt and braces.

    So, don't fret, don't lie, if you are sure that you're identified as driver, don't worry about it and just use the guide in the sticky. You'll still be paying nothing, you just need to carefully check back in when you get your rejection of your appeal, which you will, together with the POPLA appeal code, which is all you need, together with the letters available here.

    Do not pay your offer for one day. If they sulk, simply say you've changed your mind based on advice, the offer has been withdrawn.

    As it's a bylaws ticket they may well not offer POPLA and elect to prosecute under the bylaws.

    Why should they prosecute, there was no intention to defraud, restitution was swiftly made, no-one has lost anything.
    You never know how far you can go until you go too far.

    You need to make sure this is a real byelaw ticket, have you got pictures of the signs there? Who is payment and appeals to? Does it offer popla? Or the protection of freedoms act 2012 anywhere? Have you contact SWT on this ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Thanks Stroma. I'm back at the station tomorrow (won't forget to pay this time). I'll take some pictures of the signs in the area and post them up.

    The payment and appeals are both to our friends CP Plus. The event happened today and they were window stickers. I haven't had a NTK or anything about an appeal other than an autoreply in receipt of my email and there is no mention of POPLA or POFA in either the PCNs or the email reply.

    I haven't contacted SWT, is there mileage in this approach?

    Yes complain to them, I am sure that this will probably land up not being a byelaw ticket , they confuse the issue. But we do need the signs. You also can ask to see the byelaw documents from the station, they I think must have it on request. Once we know what is happening you may also want to take advice on pepipoo.com as well
