pcn at humberside airport

hi

I received a pcn from humberside airport 5 months after the the incident occurred. It was for stopping for 30 seconds near the famous busstop. I sent a letter appealing against the decision as I stated the weather was particularly bad on the night in question so the signage was not visable showing where the driver should go, and nobody entered the car or disembarked. I copied a letter that was printed on the site and received a letter yesterday on day 34 of my appeal stating they ackknowledge they are outside the timescale but will be pussing under a non-statuory route. They have sent me a popla appeals form to fill in could you please help me to write the appeal as I have never done one before..

Thanks

have a look in here https://forums.moneysavingexpert.com/discussion/4816822

there are links to suitable appeals

also use the forum search tool and the word humberside to see recent appeals and threads so you can maybe pinch one easily, as it comes up a lot

Now im appealing through popla do i still not state who the driver is. On the night in question the driver says the weather was stormy, raining and visability was very bad and they actually paused there to see which car park to go into as it was their first time driving there. Do you think this Will this help the case.
    Thanks

Correct - you appeal as the registered keeper

On the night in question the driver says the weather was stormy, raining and visability was very bad and they actually paused there to see which car park to go into as it was their first time driving there. Do you think this Will this help the case.

Phrased as it is - this is mitigation - POPLA don't do mitigation . What matters for POPLA are the tried and tested points.

Read #3 of the sticky thread that Redx gave you the link to above and take a look at other examples for Humberside as suggested and it will become clearer what wins.
for example have a read of this thread (particularly posts #6 - #11 within it)

put another way, put everything out of your head as to "what happened"

concentrate on appealing this as RK using similar appeals to all the others that have won, based on the same appeal points, nobody really cares what happened on the day, what the weather was like or any other mitigating factors as they wont win against VCS or popla , only legal appeal points will win when "solicitors" (assessors) like popla are involved

Nope. You don't see anything like that in the examples of winning POPLA wording, in the hyperlink 'How to win at POPLA' in the NEWBIES sticky thread.

In fact if you just search this forum for 'Airport relevant land' you will find dozens of recent very strong POPLA appeals posted by others, which you can copy.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
